recommended the following amendment:

and insert:

     (11) The commission shall establish a renewable energy

8

portfolio standard "RPS" that requires electric utilities to

9

generate or purchase a specified percentage of their total system

10

wide electrical power or renewable energy credits from renewable

11

energy resources located within the state. Not less than 3

12

percent of the RPS must be solar and located within the state.

13

Notwithstanding s. 366.91(3) and (4), the Commission is

14

authorized to approve projects and power sales agreements with

15

renewable power producers, and the sale of renewable energy

16

credits which are needed to comply with the RPS. In the event of

17

any conflict, this section shall supersede s. 366.91(3) and (4).

18

Municipal and cooperative utilities that are exempt from the

19

Florida Energy Efficiency and Conservation Act shall submit an

20

annual report to the commission identifying the respective

21

percentage of their electrical power that is generated or

22

purchased from such renewable energy resources. The commission

23

shall adopt rules to administer and enforce this subsection.
