     Section 89.  Section 526.06, Florida Statutes, is amended to

7

read:

8

     526.06  Mixing, blending, compounding, or adulteration of

9

liquid fuels of same manufacturer prohibited; sale of gasoline

10

blended with ethanol gasohol.--It is unlawful for any person to

11

mix, blend, compound, or adulterate the liquid fuel, lubricating

12

oil, grease, or similar product of a manufacturer or distributor

13

with a liquid fuel, lubricating oil, grease, or similar product

14

of the same manufacturer or distributor of a character or nature

15

different from the character or nature of the liquid fuel,

16

lubricating oil, grease, or similar product so mixed, blended,

17

compounded, or adulterated, and expose for sale, offer for sale,

18

or sell the same as the unadulterated product of such

19

manufacturer or distributor or as the unadulterated product of

20

any other manufacturer or distributor. However, nothing in this

21

chapter shall be construed to prevent the lawful owner of such

22

products from applying his, her, or its own trademark, trade

23

name, or symbol to any product or material. Ethanol-blended

24

Alcohol-blended fuels which contain 90 percent unleaded gasoline

25

and up to 10 percent denatured ethanol by volume ethyl alcohol of

26

a minimum of 198 proof and a maximum 50 parts per million of

27

acetic acid, commonly known as "gasohol," may be sold at retail

28

service stations for use in motor vehicles, as long as the

29

gasoline component complies with current state specifications,

30

until the American Society for Testing and Materials approves

31

specifications for gasohol. To provide retail service stations

32

flexibility during the transition period to ethanol-blended

33

fuels, the T50 and TV/L specifications for gasoline containing

34

between 9 and 10 percent ethanol shall be applied to all gasoline

35

containing between 1 and 10 percent ethanol by volume provided

36

the last three or fewer deliveries contained between 9 and 10

37

percent ethanol by volume. If there is no reasonable availability

38

of ethanol or the price of ethanol exceeds the price of gasoline,

39

the T50 and TV/L specifications for gasoline containing between 9

40

and 10 percent ethanol shall be applicable for gasoline

41

containing between 1 and 10 percent ethanol for up to three

42

deliveries of fuel.
