A bill to be entitled
2An act relating to temporary motor vehicle license tags;
3amending s. 320.131, F.S.; revising provisions for the
4placement of temporary tags on vehicles; revising
5provisions for implementation of an electronic system for
6entry of vehicle and owner data upon issuance of temporary
7tags; revising provisions for implementation of an
8electronic, print-on demand, temporary tag issuance
9system; authorizing certain motor vehicle dealers to
10charge a fee in certain circumstance; repealing s. 320.96,
11F.S., relating to implementation of an electronic, print-
12on-demand, temporary license plate system; providing an
13effective date.

15Be It Enacted by the Legislature of the State of Florida:

17     Section 1.  Subsections (4) and (8) of section 320.131,
18Florida Statutes, are amended, and subsection (9) is added to
19that section, to read:
20     320.131  Temporary tags.--
21     (4)(a)  Temporary tags shall be conspicuously displayed in
22the rear license plate bracket or, attached to the inside of the
23rear window in an upright position so as to be clearly visible
24from the rear of the vehicle. on vehicles requiring front
25display of license plates, temporary tags shall be displayed on
26the front of the vehicle in the location where the metal license
27plate would normally be displayed.
28     (b)  The department shall designate specifications for the
29media upon which the temporary tag is printed. Such media shall
30be either nonpermeable or subject to weatherproofing so that it
31maintains its structural integrity, including graphic and data
32adhesion, in all weather conditions after being placed on a
33vehicle.
34     (8)  The department shall may administer an electronic
35system for licensed motor vehicle dealers to use for in issuing
36temporary tags license plates. Upon issuing a temporary tag
37license plate, the dealer shall access the electronic system and
38enter the appropriate vehicle and owner information within the
39timeframe specified by department rule. If a dealer fails to
40comply with the department's requirements for issuing temporary
41tags license plates using the electronic system, the department
42may deny, suspend, or revoke a license under s. 320.27(9)(b)16.
43upon proof that the licensee has failed to comply with the
44department's requirements. The department may adopt rules to
45administer this section.
46     (9)  The department shall implement a secure print-on-
47demand electronic temporary tag registration, record retention,
48and issue system for use by every department-authorized issuer
49of temporary tags by the end of the 2007-2008 fiscal year. This
50system shall enable the department to issue, on demand, a
51temporary tag number in response to a request from the issuer
52via a secure electronic exchange of data and enable the issuer
53to print the temporary tag with all of the required information.
54The department may adopt rules as necessary to implement this
55program. A motor vehicle dealer licensed under this chapter
56shall be authorized to charge a fee to comply with this section.
57     Section 2.  Section 320.96, Florida Statutes, is repealed.
58     Section 3.  This act shall take effect upon becoming a law.
