Senator Deutch moved the following Senate amendment to House

insert:

     Section 10.  Paragraph (a) of subsection (3) of section

8

1012.34, Florida Statutes, is amended to read:

9

     1012.34  Assessment procedures and criteria.--

10

     (3)  The assessment procedure for instructional personnel

11

and school administrators must be primarily based on the

12

performance of students assigned to their classrooms or schools,

13

as appropriate. Pursuant to this section, a school district's

14

performance assessment is not limited to basing unsatisfactory

15

performance of instructional personnel and school administrators

16

upon student performance, but may include other criteria approved

17

to assess instructional personnel and school administrators'

18

performance, or any combination of student performance and other

19

approved criteria. The procedures must comply with, but are not

20

limited to, the following requirements:

21

     (a)  An assessment must be conducted for each employee at

22

least once a year. The assessment must be based upon sound

23

educational principles and contemporary research in effective

24

educational practices. The assessment must primarily use data and

25

indicators of improvement in student performance assessed

26

annually as specified in s. 1008.22 and may consider results of

27

peer reviews in evaluating the employee's performance. Student

28

performance must be measured by state assessments required under

29

s. 1008.22 and by local assessments for subjects and grade levels

30

not measured by the state assessment program. The assessment

31

criteria must include, but are not limited to, indicators that

32

relate to the following:

33

     1.  Performance of students.

34

     2.  Ability to maintain appropriate discipline.

35

     3.  Knowledge of subject matter. The district school board

36

shall make special provisions for evaluating teachers who are

37

assigned to teach out-of-field.

38

     4.  Ability to plan and deliver instruction and the use of

39

technology in the classroom.

40

     5.  Ability to evaluate instructional needs.

41

     6.  Ability to establish and maintain a positive

42

collaborative relationship with students' families to increase

43

student achievement.

44

     7.  Other professional competencies, responsibilities, and

45

requirements as established by rules of the State Board of

46

Education and policies of the district school board.

Pursuant to this section, a school district may determine that

49

the performance of instructional personnel and school

50

administrators is unsatisfactory based upon student performance

51

and other criteria approved to assess instructional personnel and

52

school administrators' performance or any combination thereof.

creating the Student Preparedness Pilot Program;

requiring the Duval County School District and each

83

selected school district to review and identify

84

curricula options for certain students; requiring

85

students who attain the age of 16 years but have not

86

reached the age of 18 years in pilot program districts

87

who do not regularly attend school to be subject to

88

specific attendance and completion requirements;

89

providing for an application and selection process for

90

school district participation; specifying procedures for

91

termination of school enrollment and requirements for

92

pilot program attendance and completion; specifying that

93

students who select a nontraditional academic option are

94

not eligible students for purposes of school grading;

95

requiring an annual study and reporting by the Office of

96

Program Policy Analysis and Government Accountability;

97

amending s. 1003.01, F.S.; providing that habitual

98

truancy provisions apply to students subject to pilot

99

program requirements; defining regular program

attendance in a pilot program school district; amending

s. 1003.21, F.S.; requiring a student in a pilot program

school district to be informed of attendance and

completion requirements; amending s. 1003.26, F.S.;

conforming cross-references; amending s. 1004.99, F.S.,

relating to the Florida Ready to Work Program; providing

requirements for attaining bronze, silver, and gold

107

credential levels; amending s. 1003.428, F.S.; requiring

a student to earn the credential for high school

graduation with a career or technical major area of

interest; amending s. 1009.536, F.S.; requiring a
