| 7 | Be It Enacted by the Legislature of the State of Florida: |
| 8 |

| 9 | Section 1. Section 782.065, Florida Statutes, is created |
| 10 | to read: |
| 11 | 782.065 Murder; law enforcement |
| 12 | officer.--Notwithstanding s. 775.0823, a person who commits or |
| 13 | attempts to commit murder in the first, second, or third |
| 14 | degree as described in s. 782.04, or attempted felony murder |
| 15 | as described in s. 782.051, where the victim of the offense |
| 16 | was a law enforcement officer, part-time law enforcement |
| 17 | officer, or auxiliary law enforcement officer, as those terms |
| 18 | are defined in s. 943.10, engaged in the lawful performance of |
| 19 | a legal duty shall, if the death sentence is not imposed, be |
| 20 | sentenced to a minimum mandatory term of imprisonment for life |
| 21 | without eligibility for release. |
| 22 | Section 2. This act shall take effect October 1, 2008. |
