2An act relating to specialty license plates; amending ss.
3320.08056 and 320.08058, F.S.; creating a Florida Tennis
4license plate, Lighthouse Association license plate, I
5Believe license plate, and Horse Country license plate;
6establishing annual use fees for the plates; providing for
7the distribution of use fees received from the sale of
8such plates; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Paragraphs (mmm), (nnn), (ooo), and (ppp) are
13added to subsection (4) of section 320.08056, Florida Statutes,
14to read:
15     320.08056  Specialty license plates.--
16     (4)  The following license plate annual use fees shall be
17collected for the appropriate specialty license plates:
18     (mmm)  Florida Tennis license plate, $25.
19     (nnn)  Lighthouse Association license plate, $25.
20     (ooo)  I Believe license plate, $25.
21     (ppp)  Horse Country license plate, $25.
22     Section 2.  Subsections (65), (66), (67), and (68) are
23added to section 320.08058, Florida Statutes, to read:
24     320.08058  Specialty license plates.--
25     (65)  FLORIDA TENNIS LICENSE PLATES.--
26     (a)  The department shall develop a Florida Tennis license
27plate as provided in this section. The word "Florida" must
28appear at the top of the plate, and the words "Play Tennis" must
29appear at the bottom of the plate. The United States Tennis
30Association Florida Section Foundation may submit a revised
31sample plate for consideration by the department.
32     (b)  The annual use fees shall be distributed to the
33Florida Sports Foundation, a direct-support organization of the
34Office of Tourism, Trade, and Economic Development. The license
35plate annual use fees shall be annually allocated as follows:
36     1.  The United States Tennis Association Florida Section
37shall receive the first $60,000 in proceeds from the annual use
38fees to reimburse it for startup costs, administrative costs,
39and other costs it incurs in the development and approval
40process.
41     2.  Up to 5 percent of the proceeds from the annual use
42fees may be used by the Florida Sports Foundation to administer
43the license plate program.
44     3.  Up to 5 percent of the annual use fees may be used for
45promoting and marketing the license plates.
46     4.  The remaining proceeds shall be made available by the
47Florida Sports Foundation for grants awarded by the United
48States Tennis Association Florida Section Foundation to benefit
49nonprofit organizations to operate youth tennis programs and
50adaptive tennis programs for special populations of all ages,
51and for building, renovating, and maintaining public tennis
52courts.
53     (66)  LIGHTHOUSE LICENSE PLATES.--
54     (a)  The department shall develop a Lighthouse license
55plate as provided in this section. The word "Florida" must
56appear at the top of the plate, and the words "Visit Our Lights"
57must appear at the bottom of the plate.
58     (b)  The annual use fee shall be distributed to the Florida
59Lighthouse Association, Inc., which may use a maximum of 10
60percent of the proceeds to promote and market the plate. The
61remaining proceeds shall be used by the association to fund the
62preservation, restoration, and protection of the 29 historic
63lighthouses remaining in the state.
64     (67)  I BELIEVE LICENSE PLATES.--
65     (a)  Notwithstanding s. 320.08053, the department shall
66develop an I BELIEVE license plate as provided in this section.
67I BELIEVE license plates must bear the colors and design
68approved by the department. The word "Florida" must appear at
69the top of the plate, and the words "I BELIEVE" must appear at
70the bottom of the plate.
71     (b)  The requirements of s. 320.08053 must be met prior to
72the issuance of the plate. Thereafter, the license plate annual
73use fees shall be distributed to Faith in Teaching, Inc., to
74fund activities, programs, and projects that promote faith-based
75education for youth within the state. Faith in Teaching, Inc.,
76may retain all revenue from the annual use fees until all
77startup costs for developing and establishing the plate have
78been recovered. Thereafter, up to 10 percent of the annual use
79fee revenue may be used for administrative, promotional, and
80marketing costs.
81     (68)  HORSE COUNTRY LICENSE PLATES.--
82     (a)  Notwithstanding s. 320.08053, the department shall
83develop a Horse Country license plate as provided in this
84section. Horse Country license plates must bear the colors and
85design approved by the department. The word "Florida" must
86appear at the top of the plate, and the words "Horse Country"
87must appear at the bottom of the plate.
88     (b)  The requirements of s. 320.08053 must be met prior to
89the issuance of the plate. Thereafter, the license plate annual
90use fees shall be distributed to PCMI Properties, Inc., to fund
91programs involved in the rehabilitation of at-risk youth as
92directed by the Board of Trustees of PCMI Properties, Inc. Such
93funds may be used to provide educational materials, athletic
94equipment, transportation, food, medical services, counseling,
95scholarships, and other direct administrative and program
96expenses. The funds may also be used as grants for expansion of
97youth rehabilitation programs in the state. Special
98consideration shall be given to programs using horses and other
99livestock in the efforts to redirect at-risk youth. PCMI
100Properties, Inc., may retain all revenue from the annual use
101fees until all startup costs for developing and establishing the
102plate have been recovered. Thereafter, up to 10 percent of the
103annual use fee revenue may be used for promotion and marketing
104of the plate, and as necessary for annual audit or compliance
105affidavit costs.
106     Section 3.  This act shall take effect November 1, 2008.
