2An act relating to specialty license plates; amending ss.
3320.08056 and 320.08058, F.S.; creating a Florida Tennis
4license plate; creating a Lighthouse Association license
5plate; creating an I Believe license plate; creating an In
6God We Trust license plate; creating a Horse Country
7license plate; establishing annual use fees for the
8plates; providing for the distribution of use fees
9received from the sale of such plates; providing an
10effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraphs (mmm), (nnn), (ooo), (ppp), and
15(qqq) are added to subsection (4) of section 320.08056, Florida
16Statutes, to read:
17     320.08056  Specialty license plates.--
18     (4)  The following license plate annual use fees shall be
19collected for the appropriate specialty license plates:
20     (mmm)  Florida Tennis license plate, $25.
21     (nnn)  Lighthouse Association license plate, $25.
22     (ooo)  I Believe license plate, $25.
23     (ppp)  In God We Trust license plate, $25.
24     (qqq)  Horse Country license plate, $25.
25     Section 2.  Subsections (65), (66), (67), (68), and (69)
26are added to section 320.08058, Florida Statutes, to read:
27     320.08058  Specialty license plates.--
28     (65)  FLORIDA TENNIS LICENSE PLATES.--
29     (a)  The department shall develop a Florida Tennis license
30plate as provided in this section. The word "Florida" must
31appear at the top of the plate, and the words "Play Tennis" must
32appear at the bottom of the plate. The United States Tennis
33Association Florida Section Foundation may submit a revised
34sample plate for consideration by the department.
35     (b)  The annual use fees shall be distributed to the
36Florida Sports Foundation, a direct-support organization of the
37Office of Tourism, Trade, and Economic Development. The license
38plate annual use fees shall be annually allocated as follows:
39     1.  The United States Tennis Association Florida Section
40shall receive the first $60,000 in proceeds from the annual use
41fees to reimburse it for startup costs, administrative costs,
42and other costs it incurs in the development and approval
43process.
44     2.  Up to 5 percent of the proceeds from the annual use
45fees may be used by the Florida Sports Foundation to administer
46the license plate program.
47     3.  Up to 5 percent of the annual use fees may be used for
48promoting and marketing the license plates.
49     4.  The remaining proceeds shall be made available by the
50Florida Sports Foundation for grants awarded by the United
51States Tennis Association Florida Section Foundation to benefit
52nonprofit organizations to operate youth tennis programs and
53adaptive tennis programs for special populations of all ages,
54and for building, renovating, and maintaining public tennis
55courts.
56     (66)  LIGHTHOUSE LICENSE PLATES.--
57     (a)  The department shall develop a Lighthouse license
58plate as provided in this section. The word "Florida" must
59appear at the top of the plate, and the words "Visit Our Lights"
60must appear at the bottom of the plate.
61     (b)  The annual use fee shall be distributed to the Florida
62Lighthouse Association, Inc., which may use a maximum of 10
63percent of the proceeds to promote and market the plate. The
64remaining proceeds shall be used by the association to fund the
65preservation, restoration, and protection of the 29 historic
66lighthouses remaining in the state.
67     (67)  I BELIEVE LICENSE PLATES.--
68     (a)  Notwithstanding s. 320.08053, the department shall
69develop an I BELIEVE license plate as provided in this section.
70I BELIEVE license plates must bear the colors and design
71approved by the department. The word "Florida" must appear at
72the top of the plate, and the words "I BELIEVE" must appear at
73the bottom of the plate.
74     (b)  The requirements of s. 320.08053 must be met prior to
75the issuance of the plate. Thereafter, the license plate annual
76use fees shall be distributed to Faith in Teaching, Inc., to
77fund activities, programs, and projects that promote faith-based
78education for youth within the state. Faith in Teaching, Inc.,
79may retain all revenue from the annual use fees until all
80startup costs for developing and establishing the plate have
81been recovered. Thereafter, up to 10 percent of the annual use
82fee revenue may be used for administrative, promotional, and
83marketing costs.
84     (68)  IN GOD WE TRUST LICENSE PLATES.--
85     (a)  The department shall develop an In God We Trust
86license plate as provided in this section. However, the
87requirements of s. 320.08053 must be met before the plates are
88issued. In God We Trust license plates must bear the colors and
89design approved by the department. The word "Florida" must
90appear at the top of the plate, and the words "In God We Trust"
91must appear in the body of the plate.
92     (b)  The license plate annual use fees shall be distributed
93to the In God We Trust Foundation, Inc., to fund educational
94scholarships for the children of Florida residents who are
95members of the United States Armed Forces, the National Guard,
96and the United States Armed Forces Reserve and for the children
97of public safety employees who have died in the line of duty who
98are not covered by existing state law. Funds shall also be
99distributed to other 501(c)(3) organizations that may apply for
100grants and scholarships and to provide educational grants to
101public and private schools to promote the historical and
102religious significance of American and Florida history. The In
103God We Trust Foundation, Inc., shall distribute the license
104plate annual use fees in the following manner:
105     1.  The In God We Trust Foundation, Inc., shall retain all
106revenues from the sale of such plates until all startup costs
107for developing and establishing the plate have been recovered.
108     2.  Ten percent of the funds received by the In God We
109Trust Foundation, Inc., shall be expended for administrative
110costs, promotion, and marketing of the license plate directly
111associated with the operations of the In God We Trust
112Foundation, Inc.
113     3.  All remaining funds shall be expended by the In God We
114Trust Foundation, Inc., for programs.
115     (69)  HORSE COUNTRY LICENSE PLATES.--
116     (a)  Notwithstanding s. 320.08053, the department shall
117develop a Horse Country license plate as provided in this
118section. Horse Country license plates must bear the colors and
119design approved by the department. The word "Florida" must
120appear at the top of the plate, and the words "Horse Country"
121must appear at the bottom of the plate.
122     (b)  The requirements of s. 320.08053 must be met prior to
123the issuance of the plate. Thereafter, the license plate annual
124use fees shall be distributed to PCMI Properties, Inc., to fund
125programs involved in the rehabilitation of at-risk youth as
126directed by the Board of Trustees of PCMI Properties, Inc. Such
127funds may be used to provide educational materials, athletic
128equipment, transportation, food, medical services, counseling,
129scholarships, and other direct administrative and program
130expenses. The funds may also be used as grants for expansion of
131youth rehabilitation programs in the state. Special
132consideration shall be given to programs using horses and other
133livestock in the efforts to redirect at-risk youth. PCMI
134Properties, Inc., may retain all revenue from the annual use
135fees until all startup costs for developing and establishing the
136plate have been recovered. Thereafter, up to 10 percent of the
137annual use fee revenue may be used for promotion and marketing
138of the plate, and as necessary for annual audit or compliance
139affidavit costs.
140     Section 3.  This act shall take effect October 1, 2008.
