| 9 | (3) Upon written request by the contractor, the board |
| 10 | shall waive the written statement requirement under subsection |
| 11 | (1) if the contractor provides evidence of operational practices |
| 12 | and financial security sufficient to ensure no payments will be |
| 13 | made from the recovery fund as a result of work performed by the |
| 14 | contractor. |
| 15 | Section 7. Subsection (3) is added to section 713.015, |
| 16 | Florida Statutes, to read: |
| 17 | 713.015 Mandatory provisions for direct contracts.-- |
| 18 | (3) A contractor shall be exempt from this section if: |
| 19 | (a) The contractor, prior to execution of the contract, |
| 20 | provides written notice to the Construction Industry Licensing |
| 21 | Board that it waives its right to place a lien on a property for |
| 22 | nonpayment; and |
| 23 | (b) The contractor has secured a written release of lien |
| 24 | from any person or company performing work on the contractor's |
| 25 | behalf prior to that person or company performing any work on |
| 26 | the property in question. |
