An act relating to motor vehicle registration; amending s.

320.02, F.S.; allowing an applicant for a motor vehicle

4

registration or renewal to make a voluntary contribution

5

to Family First; amending s. 322.08, F.S.; allowing an

6

applicant for a driver's license to make a voluntary

7

contribution to Family First; amending s. 322.18, F.S.;

8

requiring the driver license application form for renewal

9

issuance or renewal extension to include an option to make

10

a voluntary contribution to Family First; providing an

11

effective date.

Be It Enacted by the Legislature of the State of Florida:

14

15

     Section 1.  Paragraph (f) is added to subsection (16) of

16

section 320.02, Florida Statutes, to read:

17

     320.02  Registration required; application for registration;

18

forms.--

     (f) The application form for motor vehicle registration and

21

renewal of registration must include language permitting a

22

voluntary contribution of $1 to Family First. Such contributions

23

must be transferred by the department each month to Family First,

24

a nonprofit organization.

For the purpose of applying the service charge provided in s.

27

215.20, contributions received under this subsection are not

28

income of a revenue nature.

     Section 2.  Subsection (6) of section 322.08, Florida

30

Statutes, is amended to read:

31

     322.08  Application for license.--

32

     (6)  The application form for a driver's license or

33

duplicate thereof shall include language permitting the

34

following:

35

     (a)  A voluntary contribution of $5 per applicant, which

36

contribution shall be transferred into the Election Campaign

37

Financing Trust Fund.

38

     (b)  A voluntary contribution of $1 per applicant, which

39

contribution shall be deposited into the Florida Organ and Tissue

40

Donor Education and Procurement Trust Fund for organ and tissue

41

donor education and for maintaining the organ and tissue donor

42

registry.

     (c)  A voluntary contribution of $1 per applicant, which

44

contribution shall be distributed to the Florida Council of the

45

Blind.

     (d)  A voluntary contribution of $2 per applicant, which

47

shall be distributed to the Hearing Research Institute,

48

Incorporated.

49

     (e)  A voluntary contribution of $1 per applicant, which

50

shall be distributed to the Juvenile Diabetes Foundation

51

International.

     (f)  A voluntary contribution of $1 per applicant, which

53

shall be distributed to the Children's Hearing Help Fund.

     (g) A voluntary contribution of $1 per applicant, which

55

shall be distributed to Family First, a nonprofit organization.

A statement providing an explanation of the purpose of the trust

58

funds shall also be included. For the purpose of applying the

59

service charge provided in s. 215.20, contributions received

60

under paragraphs (c), (d), (e), and (f), and (g) and under s.

61

322.18(9)(a) are not income of a revenue nature.

     Section 3.  Subsection (9) of section 322.18, Florida

63

Statutes, is amended to read:

64

     322.18  Original applications, licenses, and renewals;

65

expiration of licenses; delinquent licenses.--

66

     (9)(a)  The application form for a renewal issuance or

67

renewal extension shall include language permitting a voluntary

68

contribution of $1 per applicant, to be quarterly distributed by

69

the department to Prevent Blindness Florida, a not-for-profit

70

organization, to prevent blindness and preserve the sight of the

71

residents of this state. A statement providing an explanation of

72

the purpose of the funds shall be included with the application

73

form.

     (b) Prior to the department distributing the funds

75

collected pursuant to this paragraph (a), Prevent Blindness

76

Florida must submit a report to the department that identifies

77

how such funds were used during the preceding year.

     (b) The application form for a renewal issuance or renewal

79

extension shall include language permitting a voluntary

80

contribution of $1 per applicant to Family First.

81

     Section 4.  This act shall take effect October 1, 2008.
