| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Subsection (5) of section 1008.331, Florida |
| 12 | Statutes, is renumbered as subsection (6) and a new subsection |
| 13 | (5) is added to that section to read: |
| 14 | 1008.331 Supplemental educational services in Title I |
| 15 | schools; school district, and provider, and department |
| 16 | responsibilities.-- |
| 17 | (5) RESPONSIBILITIES OF THE DEPARTMENT OF EDUCATION.-- |
| 18 | (a) Beginning with the 2007-2008 school year, the |
| 19 | department shall annually assign to each state-approved |
| 20 | supplemental educational services provider one of the following |
| 21 | grades, defined according to rules of the State Board of |
| 22 | Education: |
| 23 | 1. "A," providing superior service. |
| 24 | 2. "B," providing above satisfactory service. |
| 25 | 3. "C," providing satisfactory service. |
| 26 | 4. "D," providing below satisfactory service. |
| 27 | 5. "F," providing unsatisfactory service. |
| 28 | (b) A state-approved supplemental educational services |
| 29 | provider's grade shall be based on a combination of student |
| 30 | learning gains and student proficiency levels as measured by the |
| 31 | statewide assessment pursuant to s. 1008.22 for students in |
| 32 | grades 4 through 12 and norm-referenced tests approved by the |
| 33 | department for students in kindergarten through grade 3. |
| 34 | (c) The department shall report by March 1, 2009, and by |
| 35 | March 1 each year thereafter, the grades it assigns under this |
| 36 | subsection to the supplemental educational services providers, |
| 37 | the school districts, parents, and the public. |
| 38 | Section 2. This act shall take effect July 1, 2008. |
