3     Amendment (with title amendment)
4     Between lines 276 and 277, insert:
5     Section 5.  Paragraph (b) of subsection (2) of section
61012.865, Florida Statutes, is amended to read:
7     1012.865  Sick leave.--Each community college board of
8trustees shall adopt rules whereby any full-time employee who is
9unable to perform his or her duties at the community college on
10account of personal sickness, accident disability, or extended
11personal illness, or because of illness or death of the
12employee's father, mother, brother, sister, husband, wife,
13child, or other close relative or member of the employee's own
14household, and who consequently has to be absent from work shall
15be granted leave of absence for sickness by the president or by
16the president's designated representative. The following
17provisions shall govern sick leave:
18     (2)  EXTENT OF LEAVE WITH COMPENSATION.--
19     (b)  A community college board of trustees may establish
20rules and prescribe procedures whereby a full-time employee may,
21at the beginning date of employment in any year, be credited
22with 12 days of sick leave with compensation in excess of the
23number of days the employee has earned. Upon termination of
24employment, the employee's final compensation shall be adjusted
25in an amount necessary to ensure that sick leave with
26compensation does not exceed the days of earned sick leave as
27provided herein. Accumulated sick leave may be transferred from
28a Florida community college to the Department of Education for
29employment in the department subsequent to December 31, 1997.
30However, not more than 104 hours of sick leave may be
31transferred from the community college to the Department of
32Education for each year of employment in the department.
