| 4 | Remove line 73 and insert: |
| 5 | (5) If the department determines that it is in the best |
| 6 | interest of the public, the department may pay a stipend to |
| 7 | unsuccessful firms who have submitted responsive proposals on |
| 8 | design/build contracts. The decision and amount of a stipend |
| 9 | will be based upon department analysis of the estimated cost of |
| 10 | the project, the estimated proposal development costs, and the |
| 11 | anticipated degree of competition during the procurement |
| 12 | process. Stipends shall be used to encourage competition and |
| 13 | compensate only the shortlisted firms who are not successful for |
| 14 | a portion of their proposal development costs. The department is |
| 15 | then able to use ideas from unsuccessful firms that accept a |
| 16 | stipend. |
