3     Amendment (with title amendment)
4     Remove line 73 and insert:
5     (5)  If, in its discretion, it determines that it is
6in the best interests of the public, the Department of
7Transportation may pay a stipend to firms who have submitted
8responsive proposals on design/build contracts unsuccessfully.
9The decision to pay a stipend and the amount thereof shall be
10based upon the department's analysis of the estimated cost of
11the project, the estimated proposal development costs, and the
12anticipated degree of competition during the procurement
13process. Stipends shall be used to encourage competition and
14compensate only the shortlisted firms that unsuccessfully
15submitted proposals for a portion of their proposal development
16costs. The department shall be able to use ideas from firms that
17were unsuccessful in their submission of a proposal and that
18have accepted a stipend under this subsection.
19     (6) The department shall adopt rules pursuant to chapter
