An act relating to a review under the Open Government

Sunset Review Act; reenacting s. 626.97411, F.S., relating

to reports by insurers to the Office of Insurance

Regulation which contain credit scoring methodologies and

6

related data that are trade secrets; repealing s. 2 of

7

chapter 2003-408, Laws of Florida; deleting provisions

8

providing for repeal of the exemption; providing an

9

effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 626.97411, Florida Statutes, is

14

reenacted to read:

15

     626.97411  Public records exemption for the Office of

16

Insurance Regulation.--Credit scoring methodologies and related

17

data and information that are trade secrets as defined in s.

18

688.002 and that are filed with the Office of Insurance

19

Regulation pursuant to a rate filing or other filing required by

20

law are confidential and exempt from the provisions of s.

21

119.07(1) and s. 24(a), Art. I of the State Constitution.

     Section 2. Section 2 of chapter 2003-408, Laws of Florida,

23

is repealed.

     Section 3.  This act shall take effect October 1, 2008.
