3     Amendment (with title amendment)
4     Between lines 208-209 insert:
5     Section 5.  Subsection (1) of section 327.50, Florida
6Statutes, is amended to read:
7     327.50  Vessel safety regulations; equipment and lighting
8requirements.--
9     (1)(a)  The owner and operator of every vessel on the
10waters of this state shall carry, store, maintain, and use
11safety equipment in accordance with current United States Coast
12Guard safety equipment requirements as specified in the Code of
13Federal Regulations, unless expressly exempted by the
14department.
15     (b)  No person shall operate a recreational vessel less
16than 26 feet in length on the waters of this state unless every
17person under 13 6 years of age on board the vessel is wearing a
18type I, type II, or type III Coast Guard approved personal
19flotation device or is located below deck or in an enclosed
20cabin while such vessel is underway. For the purpose of this
21section, "underway" shall mean at all times except when a vessel
22is anchored, moored, made fast to the shore, or aground.
23     (c)  No person shall use a recreational vessel on the
24waters of this state unless at least one type I, type II, or
25type III Coast Guard approved personal flotation device is on
26board for each person. Recreational vessels 16 feet or more in
27length shall have at least one type IV Coast Guard approved
28personal flotation device on board in addition to the
29requirements of this paragraph.
