5     Section 1.  Paragraphs (b), (e), (k), and (u) of subsection
6(3) of section 1000.21, Florida Statutes, are amended to read:
7     1000.21  Systemwide definitions.--As used in the Florida K-
820 Education Code:
9     (3)  "Community college," except as otherwise specifically
10provided, includes the following institutions and any branch
11campuses, centers, or other affiliates of the institution:
12     (b)  Broward Community College.
13     (e)  Daytona Beach Community College.
14     (k)  Indian River Community College.
15     (u)  Polk Community College.
16     Section 2.  Section 1001.60, Florida Statutes, is created
17to read:
18     1001.60  Florida College System.--
19     (1)  PURPOSES.--In order to maximize open access for
20students, respond to community needs for postsecondary academic
21education and career degree education, and provide associate and
22baccalaureate degrees that will best meet the state's employment
23needs, the Legislature establishes a system of governance for
24the Florida College System.
25     (2)  FLORIDA COLLEGE SYSTEM.--There shall be a single
26Florida College System comprised of the public postsecondary
27educational institutions identified in s. 1000.21(3) that grant
282-year and 4-year academic degrees as provided by law. An
29institution within the Florida College System may not offer
30graduate degree programs.
31     (a)  The programs and services offered by institutions in
32the Florida College System in providing associate and
33baccalaureate degrees shall be delivered in a cost-effective
34manner that demonstrates substantial savings to the student and
35to the state over the cost of providing the degree at a state
36university.
37     (b)1.  With the approval of the institution's local board
38of trustees, an institution in the Florida College System may
39change the institution's name and use the designation "college"
40if it has been authorized to grant baccalaureate degrees
41pursuant to s. 1004.73 or s. 1007.33 or if it has received
42approval from the State Board of Education pursuant to this
43paragraph.
44     2.  With the approval of an institution's local board of
45trustees, any institution in the Florida College System may
46request approval from the State Board of Education to change the
47institution's name and use the designation "college." The State
48Board of Education may approve the request if the institution
49enters into an agreement with the State Board of Education to do
50the following:
51     a.  Maintain as the institution's primary mission
52responsibility for responding to community needs for
53postsecondary academic education and career degree education as
54prescribed in s. 1004.65(6).
55     b.  Maintain an open-door admissions policy for associate-
56level degree programs and workforce education programs.
57     c.  Continue to provide outreach to underserved
58populations.
59     d.  Continue to provide remedial education.
60     e.  Comply with all provisions of the statewide
61articulation agreement that relate to 2-year and 4-year public
62degree-granting institutions as adopted by the State Board of
63Education pursuant to s. 1007.23.
64     3.  An institution in the Florida College System shall not
65use the designation "university."
66     (3)  LOCAL BOARDS OF TRUSTEES.--Each institution within the
67Florida College System shall be governed by a local board of
68trustees as provided in s. 1001.64. The membership of each local
69board of trustees shall be as provided in s. 1001.61.
70     Section 3.  Section 1004.35, Florida Statutes, is amended
71to read:
72     1004.35  Broward County campuses of Florida Atlantic
73University; coordination with other institutions.--The State
74Board of Education, the Board of Governors, and Florida Atlantic
75University shall consult with Broward Community College and
76Florida International University in coordinating course
77offerings at the postsecondary level in Broward County. Florida
78Atlantic University may contract with the Board of Trustees of
79Broward Community College and with Florida International
80University to provide instruction in courses offered at the
81Southeast Campus. Florida Atlantic University shall increase
82course offerings at the Southeast Campus as facilities become
83available.
84     Section 4.  Section 1004.87, Florida Statutes, is created
85to read:
86     1004.87  Florida College System Task Force.--
87     (1)  The Florida College System Task Force is established
88within the Division of Community Colleges of the Department of
89Education for the purpose of developing findings and issuing
90recommendations regarding the transition of community colleges
91to baccalaureate-degree-granting colleges and the criteria for
92establishing and funding state colleges.
93     (2)(a)  All members of the task force must be appointed on
94or before August 31, 2008, and the task force shall hold its
95first meeting on or before September 15, 2008.
96     (b)1.  The task force shall be comprised of the
97Commissioner of Education and 11 members appointed by the
98Commissioner.
99     2.  The Commissioner of Education shall be a voting member
100of the task force and the chair of the task force.
101     3.  The appointees shall include seven community college
102presidents, one state university president, the president of an
103institution that is eligible to participate in the William L.
104Boyd, IV, Florida Resident Access Grant Program, the president
105of an institution that is licensed by the Commission for
106Independent Education and grants baccalaureate degrees, and one
107member at large. The community college presidents appointed to
108the task force may not include the presidents of the
109institutions named to participate in the State College Pilot
110Project. The community college presidents appointed to the task
111force must reflect the diversity of program offerings and
112service areas of the 28 community colleges and include
113representatives of community colleges that are authorized to
114grant baccalaureate degrees, community colleges that are not
115authorized to grant baccalaureate degrees, community colleges
116that have urban service areas, community colleges that have
117rural service areas, community colleges the service areas of
118which have populations of 500,000 or more, and community
119colleges the service areas of which have populations of fewer
120than 500,000.
121     (3)  The task force shall:
122     (a)  Recommend a program approval process for new
123baccalaureate degree programs that are designed to meet the
124employment needs of Florida, including approval as a
125baccalaureate-degree-granting community college and as a state
126college.
127     (b)  Recommend a funding model that considers projected
128enrollment, adjustments for actual enrollment, program mix, and
129comparable support for similar programs across all institutions,
130including state colleges and community colleges authorized by
131the State Board of Education to award baccalaureate degrees
132pursuant to s. 1007.33. The funding model must ensure that the
133programs and services offered by institutions in the Florida
134College System in providing associate and baccalaureate degrees
135are delivered in a cost-effective manner that demonstrates
136substantial savings to the student and to the state over the
137cost of providing the degree at a state university.
138     (c)  Identify the areas, both geographic and academic, in
139which an increased number of graduates who have baccalaureate
140degrees are necessary in order to meet regional and statewide
141workforce needs.
142     (d)  Monitor implementation of the State College Pilot
143Project.
144     (e)  Recommend priorities and criteria for baccalaureate
145programs that may be offered without specific approval by the
146State Board of Education.
147     (4)  Any recommendation from the task force to the
148Legislature requires approval by at least three-fourths of the
149membership of the task force.
150     (5)  The task force shall be staffed by existing employees
151of the Division of Community Colleges.
152     (6)(a)  Community colleges, state universities, the
153Commission for Independent Education, and the Agency for
154Workforce Innovation shall provide information and assistance to
155the task force.
156     (b)  Independent postsecondary educational institutions,
157representatives of the business community, and other
158stakeholders are encouraged to provide the task force with
159information to assist the task force in its deliberations.
160     (7)  The task force shall submit a report and
161recommendations to the Governor, the State Board of Education,
162the President of the Senate, and the Speaker of the House of
163Representatives by March 2, 2009. The report must include any
164comments from the task force regarding the final report
165resulting from the State College Pilot Project and any specific
166recommendations of the task force for legislative action during
167the 2009 Regular Session of the Legislature.
168     (8)  The task force shall be dissolved effective June 30,
1692010, prior to which time it shall issue its final report with
170recommended detailed criteria for implementing the Florida
171College System as a permanent part of the state system of higher
172education.
173     Section 5.  Section 1004.875, Florida Statutes, is created
174to read:
175     1004.875  State College Pilot Project.--
176     (1)  The Legislature finds that it is in the best interest
177of the state to provide the residents of the state affordable
178access to baccalaureate degree programs that are designed to
179meet regional and statewide employment needs.
180     (2)(a)  Beginning with the 2008-2009 fiscal year, the State
181College Pilot Project is created, which shall be conducted by
182Chipola College, Daytona Beach College, Indian River College,
183Miami Dade College, Okaloosa-Walton College, Polk College, Santa
184Fe Community College, and St. Petersburg College in
185collaboration with the Florida College System Task Force. The
186purpose of the pilot project is to recommend to the Legislature
187an approval process for the transition of baccalaureate-degree-
188granting community colleges to state colleges in order to meet
189the employment needs of Florida, criteria for the transition of
190institutions in the Florida College System to state colleges,
191and a funding model for the Florida College System.
192     (b)  With the approval of the community college's board of
193trustees and continued compliance with the provisions of
194subsection (3), a community college identified in paragraph (a)
195as a participant in the State College Pilot Project may change
196the institution's name and use the designation "state college."
197An institution participating in the State College Pilot Project
198shall not use the designation "university."
199     (3)  The institutions participating in the pilot project
200shall:
201     (a)  Maintain, as the institution's primary mission,
202responsibility for responding to community needs for
203postsecondary academic education and career degree education as
204prescribed in s. 1004.65(6).
205     (b)  Maintain an open-door admissions policy for associate-
206level degree programs and workforce education programs.
207     (c)1.  Require, as a condition of admission to upper-
208division programs, successful completion of the college-level
209communication and mathematics skills examination (CLAST),
210established pursuant to s. 1008.29, unless the student has been
211awarded an associate degree from a community college or a state
212university.
213     2.  For purposes of a longitudinal analysis of the CLAST,
214and notwithstanding any other provision of law to the contrary,
215administer the CLAST to each student admitted to an upper-
216division program unless the student has previously achieved the
217minimum scores that constitute successful completion of the
218examination as established pursuant to s. 1008.29(4). The
219institution shall report annually the test scores of each
220student tested pursuant to the provisions of this subparagraph
221and any exemption the student has been provided pursuant to s.
2221008.29(9) to the Florida College System Task Force until its
223dissolution, to the State Board of Education once the task force
224is dissolved, and to the Office of Program Policy Analysis and
225Government Accountability.
226     (d)  Continue to provide outreach to underserved
227populations.
228     (e)  Continue to provide remedial education.
229     (f)  Comply with all provisions of the statewide
230articulation agreement that relate to 2-year and 4-year public
231degree-granting institutions as adopted by the State Board of
232Education pursuant to s. 1007.23.
233     (g)  Be prohibited from awarding graduate credit or
234graduate degrees.
235     (h)  Be prohibited from participating in intercollegiate
236athletics beyond the 2-year level.
237     (i)  Deliver the programs and services in providing
238associate and baccalaureate degrees in a cost-effective manner
239that demonstrates substantial savings to the student and to the
240state over the cost of providing the degree at a state
241university.
242     (4)(a)  The institutions participating in the pilot project
243shall collaborate with the Florida College System Task Force to
244make recommendations to the State Board of Education, the
245President of the Senate, and the Speaker of the House of
246Representatives on specific issues that should be addressed in
247the transition of a community college to a state college. Any
248recommendations of the institutions participating in the pilot
249project require approval by three-fourths of the participating
250project require approval by three-fourths of the participating
