3     Amendment (with title amendment)
4     Between lines 2941and 2942 insert:
5     Section 61.  Section 372.85, Florida Statutes, is
6renumbered as section 379.29, Florida Statutes, to read:
7     379.29 372.85  Contaminating fresh waters.--
8     (1)  It shall be unlawful for any person or persons, firm
9or corporation to cause any dyestuff, coal tar, oil, sawdust,
10poison, or deleterious substances to be thrown, run, or drained
11into any of the fresh running waters of this state in quantities
12sufficient to injure, stupefy, or kill fish which may inhabit
13the same at or below the point where any such substances are
14discharged, or caused to flow or be thrown into such waters;
15provided, that it shall not be a violation of this section for
16any person, firm, or corporation engaged in any mining industry
17to cause any water handled or used in any branch of such
18industry to be discharged on the surface of land where such
19industry or branch thereof is being carried on under such
20precautionary measures as shall be approved by the Fish and
21Wildlife Conservation Commission.
22     (2)  Any person, firm or corporation violating any of the
23provisions of this section shall be guilty of a misdemeanor of
24the second degree, punishable as provided in s. 775.082 or s.
25775.083 for the first offense, and for the second or subsequent
26offense shall be guilty of a misdemeanor of the first degree,
27punishable as provided in s. 775.082 or s. 775.083.
