| 3 | information; amending s. 817.568, F.S.; reclassifying the  | 
| 4 | penalty for a felony or misdemeanor when the offender uses  | 
| 5 | the personal identification information of another person  | 
| 6 | in the commission of a crime; providing an effective date. |

| 8 | Be It Enacted by the Legislature of the State of Florida: | 
| 9 | 
  | 
| 10 |      Section 1.  Subsections (11) through (17) of section  | 
| 11 | 817.568, Florida Statutes, are renumbered as subsections (12)  | 
| 12 | through (18), respectively, and a new subsection (11) is added  | 
| 13 | to that section to read: | 
| 14 |      817.568  Criminal use of personal identification  | 
| 15 | information.-- | 
| 16 |      (11)  The penalty for any felony or misdemeanor, other than  | 
| 17 | a felony or misdemeanor provided in this section, shall be  | 
| 18 | reclassified as provided in this subsection if, during the  | 
| 19 | course of the commission of such felony or misdemeanor, the  | 
| 20 | offender used the personal identification information of another  | 
| 21 | person without obtaining that person's consent: | 
| 22 |      (a)  A misdemeanor of the second degree is reclassified to  | 
| 23 | a misdemeanor of the first degree. | 
| 24 |      (b)  A misdemeanor of the first degree is reclassified to a  | 
| 25 | felony of the third degree. | 
| 26 |      (c)  A felony of the third degree is reclassified to a  | 
| 27 | felony of the second degree. | 
| 28 |      (d)  A felony of the second degree is reclassified to a  | 
| 29 | felony of the first degree. | 
| 30 |      (e)  A felony of the first degree is reclassified to a life  | 
| 31 | felony. | 
| 32 |      Section 2.  This act shall take effect October 1, 2008. |
