| 4 | Remove line(s) 697-727 and insert: |
| 5 | maintain the adopted level of service. If the number of trips |
| 6 | used in this calculation includes trips from an earlier phase of |
| 7 | development, the determination of mitigation of the cumulative |
| 8 | project impacts for the subsequent phase of development shall |
| 9 | include a credit for any mitigation required by the development |
| 10 | order and provided by the developer for the earlier phase, |
| 11 | calculated at present value. For purposes of this subsection, |
| 12 | the term: |
| 13 | 1. "Present value" means the fair market value of right- |
| 14 | of-way at the time of contribution or the actual dollar value of |
| 15 | the construction improvements at the date of completion. |
| 16 | 2. For purposes of this subsection, "Construction cost" |
| 17 | includes all associated costs of the improvement. Proportionate- |
| 18 | share mitigation shall be limited to ensure that a development |
| 19 | of regional impact meeting the requirements of this subsection |
| 20 | mitigates its impact on the transportation system but is not |
| 21 | responsible for the additional cost of reducing or eliminating |
| 22 | backlogs. |
| 23 | 3. "Backlogged transportation facility" means a facility |
| 24 | on which the adopted level-of-service standard is exceeded by |
| 25 | the existing level of service plus committed trips. A developer |
| 26 | may not be required to fund or construct proportionate share |
| 27 | mitigation that is more extensive, due to being on a backlogged |
| 28 | transportation facility, than is necessary based solely on the |
| 29 | impact of the development project being considered. |

| 32 | pursuant to s. 380.061 and to detailed specific area plans |
| 33 | implementing optional sector plans pursuant to s. 163.3245. |
