| 5 | Section 47. Subsection (3) of section 170.01, Florida |
| 6 | Statutes, is amended to read: |
| 7 | 170.01 Authority for providing improvements and levying |
| 8 | and collecting special assessments against property benefited.-- |
| 9 | (3)(a) Any municipality, subject to the approval of a |
| 10 | majority of the affected property owners who actually vote in |
| 11 | the required vote, may levy and collect special assessments |
| 12 | against property benefited for the purpose of stabilizing and |
| 13 | improving: |
| 14 | 1.(a) Retail business districts, |
| 15 | 2.(b) Wholesale business districts, or |
| 16 | 3.(c) Nationally recognized historic districts, |
| 17 |
|
| 18 | or any combination of such districts, through promotion, |
| 19 | management, marketing, and other similar services in such |
| 20 | districts of the municipality. This paragraph subsection does |
| 21 | not authorize a municipality to use bond proceeds to fund |
| 22 | ongoing operations of these districts. |
| 23 | (b) Any municipality may determine in its resolution |
| 24 | required to declare special assessments pursuant to s. 170.03 |
| 25 | that the vote of affected property owners shall be conducted |
| 26 | either: |
| 27 | 1. By voting by tax folio numbers of affected properties; |
| 28 | or |
| 29 | 2. By voting by total square footage of the affected |
| 30 | properties. |
| 31 | Section 48. If any provision of this act or the |
| 32 | application thereof to any person or circumstance is held |
| 33 | invalid, the invalidity shall not affect other provisions or |
| 34 | applications of the act which can be given effect without the |
| 35 | invalid provision or application, and to this end the provisions |
| 36 | of this act are declared severable. |
