| 5 | Section 15. (1) Beginning in fiscal year 2008-2009, the |
| 6 | Legislature shall appropriate moneys to offset the reductions in |
| 7 | ad valorem tax revenue experienced by fiscally constrained |
| 8 | counties, as defined in s. 218.67(1), Florida Statutes, which |
| 9 | occur as a direct result of the implementation of revisions of |
| 10 | Article VII of the State Constitution approved in the special |
| 11 | election held on January 29, 2008. The moneys appropriated for |
| 12 | this purpose shall be distributed in January of each fiscal year |
| 13 | among the fiscally constrained counties based on each county's |
| 14 | proportion of the total reduction in ad valorem tax revenue |
| 15 | resulting from the implementation of the revision. |
| 16 | (2) On or before November 15 of each year, beginning in |
| 17 | 2008, each fiscally constrained county shall apply to the |
| 18 | Department of Revenue to participate in the distribution of the |
| 19 | appropriation and provide documentation supporting the county's |
| 20 | estimated reduction in ad valorem tax revenue in the form and |
| 21 | manner prescribed by the Department of Revenue. The |
| 22 | documentation must include an estimate of the reduction in |
| 23 | taxable value directly attributable to revisions of Article VII |
| 24 | of the State Constitution for all county taxing jurisdictions |
| 25 | within the county and shall be prepared by the property |
| 26 | appraiser in each fiscally constrained county. The |
| 27 | documentation must also include the county millage rates |
| 28 | applicable in all such jurisdictions for both the current year |
| 29 | and the prior year; rolled-back rates, determined as provided |
| 30 | in s. 200.065, Florida Statutes, for each county taxing |
| 31 | jurisdiction; and maximum millage rates that could have been |
| 32 | levied by majority vote pursuant to s. 200.185, Florida |
| 33 | Statutes. For purposes of this section, each fiscally |
| 34 | constrained county's reduction in ad valorem tax revenue shall |
| 35 | be calculated as 95 percent of the estimated reduction in |
| 36 | taxable value times the lesser of the 2007 applicable millage |
| 37 | rate or the applicable millage rate for each county taxing |
| 38 | jurisdiction in the prior year. |
| 39 | Section 16. Section 9 of chapter 2007-339, Laws of |
| 40 | Florida, is repealed. |
