4     Between lines 477 and 478, insert:
5163.04 Energy devices based on renewable resources.--
6
7     (2)  A deed restriction, covenant, declaration, or similar
8binding agreement may not No deed restrictions, covenants, or
9similar binding agreements running with the land shall prohibit
10or have the effect of prohibiting solar collectors,
11clotheslines, or other energy devices based on renewable
12resources from being installed on buildings erected on the lots
13or parcels covered by the deed restriction, covenant,
14declaration, or binding agreement restrictions, covenants, or
15binding agreements. A property owner may not be denied
16permission to install solar collectors or other energy devices
17based on renewable resources by any entity granted the power or
18right in any deed restriction, covenant, or similar binding
19agreement to approve, forbid, control, or direct alteration of
20property with respect to residential dwellings and within the
21boundaries of a condominium unit. not exceeding three stories in
22height. For purposes of this subsection, Such entity may
23determine the specific location where solar collectors may be
24installed on the roof within an orientation to the south or
25within 45° east or west of due south if provided that such
26determination does not impair the effective operation of the
27solar collectors.
