| 7 | (2) A deed restriction, covenant, declaration, or similar |
| 8 | binding agreement may not No deed restrictions, covenants, or |
| 9 | similar binding agreements running with the land shall prohibit |
| 10 | or have the effect of prohibiting solar collectors, |
| 11 | clotheslines, or other energy devices based on renewable |
| 12 | resources from being installed on buildings erected on the lots |
| 13 | or parcels covered by the deed restriction, covenant, |
| 14 | declaration, or binding agreement restrictions, covenants, or |
| 15 | binding agreements. A property owner may not be denied |
| 16 | permission to install solar collectors or other energy devices |
| 17 | based on renewable resources by any entity granted the power or |
| 18 | right in any deed restriction, covenant, or similar binding |
| 19 | agreement to approve, forbid, control, or direct alteration of |
| 20 | property with respect to residential dwellings and within the |
| 21 | boundaries of a condominium unit. not exceeding three stories in |
| 22 | height. For purposes of this subsection, Such entity may |
| 23 | determine the specific location where solar collectors may be |
| 24 | installed on the roof within an orientation to the south or |
| 25 | within 45° east or west of due south if provided that such |
| 26 | determination does not impair the effective operation of the |
| 27 | solar collectors. |
