     Section 37.  Effective July 1, 2008, section 16.62, Florida

8

Statutes, is created to read:

9

16.62 Coordinating Council on Gang-Reduction Strategies.-

10

(1) CREATION.-A coordinating council, as defined in s.

11

20.03, named the Coordinating Council on Gang-Reduction

12

Strategies, is established within the Department of Legal

13

Affairs. The council is subject to the provisions of s. 20.052.

14

(2) PURPOSE.-The purpose of the council is to develop and

15

implement a statewide strategy for reducing criminal street

16

gangs and gang-related crime and violence, and to coordinate and

17

give direction, guidance, and support to the efforts of federal,

18

state, and local government agencies, law enforcement, at-risk

19

youth prevention and intervention organizations, elected

20

officials, and community leaders to combat gangs in this state.

21

All recommendations of the council are subject to approval by a

22

majority of the members of the council.

23

(3) COMPOSITION.-

24

(a) The council shall consist of the following eleven

25

members:

26

1. The Attorney General or his or her designee, who shall

27

serve as chair of the council;

28

2. The Commissioner of the Florida Department of Law

29

Enforcement or his or her designee;

30

3. The Secretary of the Department of Education or his or

31

her designee;

32

4. The Secretary of the Department of Children and Families

33

or his or her designee;

34

5. The Secretary of the Department of Corrections or his or

35

her designee;

36

6. The Secretary of the Department of Juvenile Justice or

37

his or her designee;

38

7. The Director of the Office of Drug Control or his or her

39

designee;

40

8. The Director of the Florida Highway Patrol or his or her

41

designee;

42

9. The President of the Florida Sheriffs Association or his

43

or her designee;

44

10. The President of the Florida Police Chiefs Association

45

or his or her designee; and

46

11. The President of the Florida Prosecuting Attorneys

47

Association or his or her designee.

(b) Council members shall serve without compensation.

49

Members are entitled to per diem and travel expenses as provided

50

in s. 112.061. State officers and employees shall be reimbursed

51

from the budget of the agency through which they serve. Other

52

members may be reimbursed by the Department of Legal Affairs.

53

(4) MEETINGS; PROCEDURES; RECORDS.-

54

(a) The council shall meet at the call of the chair.

55

(b) The business of the council shall be presented to the

56

council in the form of an agenda. The agenda shall be set by

57

the chair and shall include items of business requested by the

58

council members.

59

(c) A majority of the members constitutes a quorum, and

60

action by a majority of a quorum shall be official.

61

(d) The minutes for each meeting shall be submitted to the

62

chair within 14 days after each meeting.

63

(5) POWERS AND DUTIES.-

64

(a) The council shall:

65

1. Gather, compile, assimilate, and facilitate the

66

distribution to government agencies and community organizations

67

of data on criminal street gangs and at-risk youth prevention

68

and intervention programs in Florida.

69

2. Develop and implement a statewide strategy to stop the

70

growth of, reduce the number of, and render ineffectual criminal

71

street gangs in Florida.

72

3. Coordinate and give guidance, direction, and support to

73

efforts by federal, state, and local government agencies, law

74

enforcement, at-risk youth prevention and intervention

75

organizations, elected officials, and community leaders to

76

combat gangs and reduce gang-related crime and violence in this

77

state, including the formation of regional task forces and local

78

and regional coalitions whose membership and direction the

79

council may determine.

(b) The council may:

81

1. Coordinate with any state agency, any political

82

subdivision, or any school district of the state in the

83

furtherance of its mission.

84

2. Request from any department, division, board, bureau,

85

commission, or other agency of the state, or of any political

86

subdivision thereof, cooperation and assistance in the

87

performance of its duties.

88

(6) EXPIRATION.-The council shall expire on December 31,

89

2009, unless reenacted by the Legislature.

90

Section 38.  Except as otherwise expressly provided in this

91

act, and except for this section, which shall take effect July

92

1, 2008, this act shall take effect October 1, 2008.
