| 5 | United States Environmental Protection Agency. A county may not |
| 6 | impose an assessment or fee for stormwater management on land |
| 7 | classified as agricultural land pursuant to s. 193.461 if the |
| 8 | agricultural operation has an agricultural discharge permit or |
| 9 | an environmental resource permit or implements best management |
| 10 | practices developed by the Department of Environmental |
| 11 | Protection, the Department of Agriculture and Consumer Services, |
| 12 | or a water management district pursuant to s. 403.067 and |
| 13 | adopted under chapter 120 as part of a statewide or regional |
| 14 | program, except under the following conditions: the ordinance |
| 15 | imposing the assessment or fee is adopted by a county required |
| 16 | to obtain a municipal separate storm sewer system permit; |
| 17 | discharges from the agricultural lands contribute to the |
| 18 | municipal separate stormwater system permitted facilities; and |
| 19 | the ordinance provides credits for the water quality and flood |
| 20 | control provided by implementation of stormwater control |
| 21 | measures against the fee or assessment charged for stormwater |
| 22 | management. A local government shall not impose a stormwater |
| 23 | management fee or assessment on forest lands or unimproved |
| 24 | pasture. |
