An act relating to display of United States flags;

providing a short title; creating ss. 125.564 and

4

166.0481, F.S.; prohibiting a county or municipality from

5

enacting or enforcing an ordinance or regulation that

6

prohibits the display of a United States flag by certain

7

persons in a respectful manner or that requires a permit

8

or payment of a fee to authorize such display; providing

9

an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. This act may be cited as the "Florida Flies the

14

Flag Act."

     Section 2.  Section 125.564, Florida Statutes, is created to

16

read:

     125.564 United States flag display regulation.--A county

18

may not enact or enforce any ordinance or regulation that

19

prohibits the display of a United States flag by a property owner

20

or tenant in a respectful manner or that requires a permit or

21

payment of a fee to authorize such display.

     Section 3.  Section 166.0481, Florida Statutes, is created

23

to read:

     166.0481 United States flag display regulation.--A

25

municipality may not enact or enforce any ordinance or regulation

26

that prohibits the display of a United States flag by a property

27

owner or tenant in a respectful manner or that requires a permit

28

or payment of a fee to authorize such display.

29

     Section 4.  This act shall take effect July 1, 2008.
