    1                        A bill to be entitled                      
    2         An act relating to state parks and preserves; amending
    3         s. 258.42, F.S.; deleting obsolete provisions
    4         regarding the establishment of rules by the Department
    5         of Environmental Protection; providing an effective
    6         date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9         
   10         Section 1. Subsection (1) of section 258.42, Florida
   11  Statutes, is amended to read:
   12         258.42 Maintenance of preserves.—The Board of Trustees of
   13  the Internal Improvement Trust Fund shall maintain such aquatic
   14  preserves subject to the following provisions:
   15         (1)(a) No further sale, lease, or transfer of sovereignty
   16  submerged lands shall be approved or consummated by the trustees
   17  except when such sale, lease, or transfer is in the public
   18  interest.
   19         (b) For purposes of this subsection, aquaculture is in the
   20  public interest and aquaculture leases may be authorized in
   21  aquatic preserves pursuant to the provisions in ss. 253.68
   22  253.75. By March 1, 1997, The Department of Environmental
   23  Protection is further directed to establish rules for freshwater
   24  aquatic preserves and urban aquatic preserves.
   25         Section 2. This act shall take effect July 1, 2009.
