| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. Paragraph (a) of subsection (2) of section |
| 11 | 776.06, Florida Statutes, is amended to read: |
| 12 | 776.06 Deadly force.-- |
| 13 | (2)(a) The term "deadly force" does not include the |
| 14 | discharge of a firearm by a law enforcement officer or |
| 15 | correctional officer during and within the scope of his or her |
| 16 | official duties which is loaded with a less-lethal munition. As |
| 17 | used in this subsection, the term "less-lethal munition" means a |
| 18 | dart-firing stun gun and any projectile that is designed to |
| 19 | stun, temporarily incapacitate, or cause temporary discomfort to |
| 20 | a person without penetrating the person's body. |
| 21 | Section 2. This act shall take effect July 1, 2009. |
