The Committee on Health Regulation (Sobel) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Section 877.04, Florida Statutes, is amended to
6 read:
7 877.04 Tattooing prohibited; penalty.—
8 (1) It is unlawful for any person to tattoo the body of any
9 human being; except that tattooing may be performed by a person
10 licensed to practice medicine or dentistry under chapters 458
11 and 459 or chapter 466, or by a person under his or her general
12 supervision as defined by the Board of Medicine.
13 (2) Any person who violates the provisions of this section
14 commits shall be guilty of a felony misdemeanor of the third
15 second degree, punishable as provided in s. 775.082, or s.
16 775.083, or s. 775.084.
17 (3) No body of a minor shall be tattooed without the
18 written notarized consent of the parent or legal guardian.
19 Section 2. This act shall take effect July 1, 2009.

25 A bill to be entitled
26 An act relating to the practice of tattooing; amending
27 s. 877.04, F.S.; increasing the criminal penalty for
28 human tattooing by unauthorized persons and for
29 tattooing a minor without the written notarized
30 consent of the parent or legal guardian; providing an
31 effective date.
