       Senator Bennett moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 539 and 540
    4  insert:
    5         Section 8. (1)(a)The state land planning agency shall
    6  implement the Energy Economic Zone Pilot Program to develop a
    7  model to help communities encourage and attain renewable
    8  electric energy generation, the manufacture of products that
    9  contribute to energy conservation, green jobs, and energy
   10  efficient land use and development patterns and building
   11  designs. The Office of Tourism, Trade, and Economic Development,
   12  within the Executive Office of the Governor and the Florida
   13  Energy and Climate Commission shall provide technical assistance
   14  to the state land planning agency in developing and
   15  administering the pilot program. The pilot program is intended
   16  to cultivate green economic development and further the
   17  implementation of chapter 2008–191, Laws of Florida, which
   18  requires that future land use elements within local government
   19  comprehensive plans are to be based on the discouragement of
   20  urban sprawl, energy-efficient land use patterns accounting for
   21  existing and future electric power generation and transmission
   22  systems, and greenhouse gas reduction strategies.
   23         (b)Sarasota County may apply to the state land planning
   24  agency to participate in the pilot program based on its record
   25  of promoting energy efficient policies and practices; and
   26  encouraging green economic development including adoption of a
   27  resolution with carbon neutral goals, an established green
   28  building and development incentive program, and a voter approved
   29  infrastructure surtax with a portion dedicated to economic
   30  development. The application shall identify the proposed
   31  location of the energy economic zone which shall be within an
   32  adopted urban service area and may include the county landfill
   33  outside the urban service boundary, present a proposed strategic
   34  plan for development and redevelopment in the energy economic
   35  zone, demonstrate consistency of the strategic plan with the
   36  local comprehensive plan or include proposed plan amendments
   37  necessary to achieve consistency, and identify comprehensive
   38  plan amendments that will be proposed to implement chapter 2008
   39  191, Laws of Florida. The strategic plan must include mixed-use
   40  and form-based standards that integrate multimodal
   41  transportation facilities with land use and development patterns
   42  to reduce reliance on automobiles, encourage certified green
   43  building developments and renewable energy systems, encourage
   44  the creation of green jobs, and demonstrate how local financial
   45  and regulatory incentives will be used in the energy economic
   46  zone. The state land planning agency shall grant the application
   47  if it meets the requirements of this section.
   48         (c)The state land planning agency and the office shall
   49  provide the pilot program community and businesses in the energy
   50  economic zone with technical assistance in identifying and
   51  qualifying for eligible grants and credits in job creation,
   52  energy, and other areas.
   53         (2)(a)The state land planning agency with the assistance
   54  of the office shall submit an interim report by February. 15,
   55  2010, to the Governor, the President of the Senate, and the
   56  Speaker of the House of Representatives regarding the status of
   57  the pilot program and any recommendations for statutory changes
   58  to accomplish the goals of the pilot program community,
   59  including whether it would be beneficial to provide financial
   60  incentives similar to those offered an enterprise zone.
   61         (b)The state land planning agency, after consultation with
   62  the office, shall submit a final report to the same officers by
   63  February 15, 2012, evaluating whether the pilot program has
   64  demonstrated any success in development and redevelopment in the
   65  energy economic zone incorporating renewable energy generation
   66  systems, low-impact design, and energy-efficient land use and
   67  development patterns and building designs, and shall recommend
   68  whether the program should be expanded for use by other local
   69  governments and whether state policies should be revised to
   70  encourage the goals of the program.

   74         Delete line 43
   75  and insert:
   76         requiring the state land planning agency to implement
   77         the Energy Economic Zone Pilot Program; requiring the
   78         Office of Tourism, Trade, and Economic Development and
   79         the Florida Energy and Climate Commission to provide
   80         technical support; providing powers and duties of the
   81         office relating to the pilot program; authorizing a
   82         specified county to apply to the state land planning
   83         agency to participate in the pilot program; requiring
   84         the state land planning agency and the office to
   85         provide the pilot community with technical assistance;
   86         providing for reports by the state land planning
   87         agency; providing an effective date.
