       The Committee on Community Affairs (Altman) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 28.12, Florida Statutes, is amended to
    6  read:
    7         28.12 Clerk of the board of county commissioners.—
    8         (1) In accordance with Article VIII of the State
    9  Constitution, when not otherwise provided by county charter or
   10  special law approved by the vote of the electors, the clerk of
   11  the circuit court shall be ex officio clerk of the board of
   12  county commissioners, auditor, recorder, and custodian of all
   13  county funds. The clerk of the circuit court shall be clerk and
   14  accountant of the board of county commissioners. He or she shall
   15  keep the minutes and accounts, prepare the financial statements
   16  and the annual financial report of the county as required by s.
   17  218.32, may make such inquiries as legally necessary to complete
   18  the financial statements and the annual financial report, and
   19  perform such other duties as provided by law. The clerk shall
   20  have custody of the seal and affix the same to any paper or
   21  instrument as required by law.
   22         (2) Except as otherwise required to complete the financial
   23  statements and the annual financial report in s. 218.32, this
   24  section does not authorize the clerk of the circuit court to
   25  perform performance, operational, post-payment audits, or the
   26  independent audits required in s. 218.39 on the county or the
   27  offices of county officers pursuant to s. 1(d), Art. VIII of the
   28  State Constitution except as otherwise provided by charter or
   29  special act approved by the vote of the electors.
   30         Section 2. This act shall take effect July 1, 2009.

   36                        A bill to be entitled                      
   37         An act relating to clerk of the county commissioners;
   38         amending s. 28.12, F.S.; requiring the clerk of the
   39         circuit court to be ex officio clerk of the board of
   40         county commissioners; requiring the clerk to prepare
   41         the financial statements and annual financial report
   42         of the county; prohibiting the clerk from performing
   43         certain audits; providing an effective date.
