| 2 | An act relating to voyeurism; amending s. 810.14, F.S.; |

| 4 | either under or through the clothing being worn by another |
| 5 | person without that person's knowledge or consent in order |
| 6 | to view the body of, or the undergarments worn by, that |
| 7 | person; providing penalties; providing an effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Section 810.14, Florida Statutes, is amended to |
| 12 | read: |
| 13 | 810.14 Voyeurism prohibited; penalties.-- |
| 14 | (1) A person commits the offense of voyeurism if that |
| 15 | person: |
| 16 | (a) when he or she, With lewd, lascivious, or indecent |
| 17 | intent, secretly observes another person when the other person |
| 18 | is located in a dwelling, structure, or conveyance and such |
| 19 | location provides a reasonable expectation of privacy; or |
| 20 | (b) For amusement, entertainment, or sexual arousal or |
| 21 | gratification, secretly views either under or through the |
| 22 | clothing being worn by another person without that person's |
| 23 | knowledge or consent in order to view the body of, or the |
| 24 | undergarments worn by, that person. |
| 25 | (2) A person who violates this section commits a |
| 26 | misdemeanor of the first degree for the first violation, |
| 27 | punishable as provided in s. 775.082 or s. 775.083. |
| 28 | (3) A person who violates this section and who has been |
| 29 | previously convicted or adjudicated delinquent two or more times |
| 30 | of any violation of this section commits a felony of the third |
| 31 | degree, punishable as provided in s. 775.082, s. 775.083, or s. |
| 32 | 775.084. |
| 33 | (4) For purposes of this section, a person has been |
| 34 | previously convicted or adjudicated delinquent of a violation of |
| 35 | this section if the violation resulted in a conviction sentenced |
| 36 | separately, or an adjudication of delinquency entered |
| 37 | separately, prior to the current offense. |
| 38 | Section 2. This act shall take effect October 1, 2009. |
