| 3 | the state; amending s. 406.61, F.S.; authorizing certain |
| 4 | accredited institutions or organizations to convey |
| 5 | plastinated bodies into or out of the state for exhibition |
| 6 | and public educational purposes; requiring that the |
| 7 | institution or organization provide prior notification and |
| 8 | documentation to the anatomical board; providing an |
| 9 | effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. Section 406.61, Florida Statutes, is amended to |
| 14 | read: |
| 15 | 406.61 Selling, buying, or conveying bodies outside state |
| 16 | prohibited; exceptions, penalty.--Any person who sells shall |
| 17 | sell or buys buy any body or parts of bodies as described in |
| 18 | this chapter or any person except a recognized Florida medical |
| 19 | or dental school who transmits shall transmit or conveys convey |
| 20 | or causes cause to be transmitted or conveyed such body or parts |
| 21 | of bodies to any place outside this state commits is guilty of a |
| 22 | misdemeanor of the first degree, punishable as provided in ss. |
| 23 | 775.082 and 775.083. However, nothing in this chapter does not |
| 24 | prohibit shall be construed as prohibiting the anatomical board |
| 25 | from transporting human specimens outside the state for |
| 26 | educational or scientific purposes or prohibit as prohibiting |
| 27 | the transport of bodies, parts of bodies, or tissue specimens in |
| 28 | furtherance of lawful examination, investigation, or autopsy |
| 29 | conducted pursuant to s. 406.11. Any person, institution, or |
| 30 | organization that conveys bodies or parts of bodies into or out |
| 31 | of the state for medical education or research purposes shall |
| 32 | notify the anatomical board of such intent and receive approval |
| 33 | from the board. Any institution or organization accredited by |
| 34 | the American Association of Museums may convey plastinated |
| 35 | bodies or parts of bodies into or out of the state for |
| 36 | exhibition and public educational purposes without the consent |
| 37 | of the board if the institution or organization notifies the |
| 38 | board of the conveyance and the duration and location of the |
| 39 | exhibition at least 30 days before the intended conveyance and |
| 40 | provides documentation that the bodies were legally donated for |
| 41 | the purpose of plastinization. |
| 42 | Section 2. This act shall take effect July 1, 2009. |
