    2         An act relating to tour guide operators; amending s.
    3         559.939, F.S.; authorizing local governments to
    4         regulate tour guide operators; providing an effective
    5         date.
    6         
    7  Be It Enacted by the Legislature of the State of Florida:
    8         
    9         Section 1. Section 559.939, Florida Statutes, is amended to
   10  read:
   11         559.939 State preemption.—No municipality or county or
   12  other political subdivision of this state shall have authority
   13  to levy or collect any registration fee or tax, as a regulatory
   14  measure, or to require the registration or bonding in any manner
   15  of any seller of travel who is registered or complies with all
   16  applicable provisions of this part, unless that authority is
   17  provided for by special or general act of the Legislature. Any
   18  ordinance, resolution, or regulation of any municipality or
   19  county or other political subdivision of this state which is in
   20  conflict with any provision of this part is preempted by this
   21  part. The provisions of this section do not apply to any local
   22  business tax levied pursuant to chapter 205. Notwithstanding any
   23  provision of this part to the contrary, any county or
   24  municipality in this state is authorized to regulate tour guide
   25  operators.
   26         Section 2. This act shall take effect July 1, 2009.
