    1                        A bill to be entitled                      
    2         An act relating to the Department of Health; amending
    3         s. 154.02, F.S.; authorizing an additional use for
    4         funds from the County Health Department Trust Fund;
    5         deleting a provision requiring certain increases in
    6         the emergency reserve of the fund based on the
    7         Consumer Price Index; repealing s. 216.2625, F.S.,
    8         relating to the disbursement of trust funds within the
    9         department and the funding of positions; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Present subsections (3), (4), and (5) of section
   15  154.02, Florida Statutes, are renumbered as subsections (4),
   16  (5), and (6), respectively, and a new subsection (3) is added to
   17  that section, and paragraph (b) of present subsection (5) of
   18  that section is amended, to read:
   19         154.02 County Health Department Trust Fund.—
   20         (3)Funds from the County Health Department Trust Fund may
   21  be expended by the Department of Health for the respective
   22  county health departments in accordance with budgets and plans
   23  agreed upon by the county authorities of each county and the
   24  Department of Health.
   25         (6)(5) At a minimum, the trust fund shall consist of:
   26         (b) An emergency reserve of $500,000, derived from an
   27  annual assessment on county health department funds based upon
   28  their proportionate share of state general revenue, maintained
   29  for county health departments to respond to public health
   30  emergencies such as epidemics and natural disasters. The
   31  emergency reserve shall be increased each July 1 by the increase
   32  in the Consumer Price Index that occurred during the previous 12
   33  months.
   34         Section 2. Section 216.2625, Florida Statutes, is repealed.
   35         Section 3. This act shall take effect July 1, 2009.
