       Senator Gelber moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1333 and 1334
    4  insert:
    5         Section 35. Subsection (4) of section 1013.40, Florida
    6  Statutes, is amended to read:
    7         1013.40 Planning and construction of community college
    8  facilities; property acquisition.—
    9         (4) The campus of a community college within a municipality
   10  designated as an area of critical state concern, as defined in
   11  s. 380.05, and having a comprehensive plan and land development
   12  regulations containing a building permit allocation system that
   13  limits annual growth, may construct dormitories for full-time up
   14  to 100 beds for community college students. Such dormitories
   15  shall be exempt from the building permit allocation system and
   16  may be constructed up to 45 feet in height provided that they
   17  are otherwise consistent with the comprehensive plan, the
   18  community college has a hurricane evacuation plan that requires
   19  all dormitory occupants to be evacuated 48 hours in advance of
   20  tropical force winds, and that transportation is provided for
   21  dormitory occupants during an evacuation.
