The Committee on Higher Education Appropriations (Lynn)
recommended the following:

4 and insert:
5 1. The tuition differential may be assessed on all
6 undergraduate courses at a state university.
7 2. For each state university that has total research and
8 development expenditures for all fields of at least $100 million
9 per year as reported annually to the National Science
10 Foundation, the aggregate sum of tuition and the tuition
11 differential may not be increased by more than 15 percent of the
12 total charged for the aggregate sum of these fees in the
13 preceding fiscal year. For each state university that has total
14 research and development expenditures for all fields of less
15 than $100 million per year as reported annually to the National
16 Science Foundation, the aggregate sum of tuition and the tuition
17 differential may not be increased by more than 12.5 percent of
18 the total charged for the aggregate sum of these fees in the
19 preceding fiscal year.
20 3. The aggregate sum of undergraduate tuition and fees per
21 credit hour, including the tuition differential, may not exceed
22 the national average of undergraduate tuition and fees at 4-year
23 degree-granting public postsecondary educational institutions.
24 4. The tuition differential may not be calculated as a part
25 of the scholarship programs established in ss. 1009.53-1009.538.
26 5. Beneficiaries having prepaid tuition contracts pursuant
27 to s. 1009.98(2)(b) which were in effect on July 1, 2007, and
28 which remain in effect, are exempt from the payment of the
29 tuition differential.
30 6. The tuition differential may not be charged to any
31 student who was in attendance at the university before July 1,
32 2007, and who maintains continuous enrollment.
33 7. The tuition differential may be waived by the university
34 for students who meet the eligibility requirements for the
35 Florida public student assistance grant established in s.
36 1009.50.
37 8. Subject to approval by the Board of Governors, the
38 tuition differential authorized pursuant to this subsection may
39 take effect with the 2009 fall term.
40 (c) A university board of trustees may submit a proposal to
41 the Board of Governors to implement a tuition differential for
42 all undergraduate courses. At a minimum, the proposal shall:
43 1. Indicate the amount that will be assessed for the
44 tuition differential.
45 2. Indicate the purpose of the tuition differential.
46 3. Indicate how the revenues from the tuition differential
47 will be used.
48 4. Indicate how the university will monitor the success of
49 the tuition differential in achieving the purpose for which the
50 tuition differential is being assessed.
51 (d) The Board of Governors shall review each proposal and
52 advise the university board of trustees of approval of the
53 proposal, the need for additional information or revision to the
54 proposal, or denial of the proposal. The Board of Governors
55 shall establish a process for any university to revise a
56 proposal or appeal a decision of the board.
57 (e) The Board of Governors shall submit a report to the
58 President of the Senate, the Speaker of the House of
59 Representatives, and the Governor describing the implementation
60 of the provisions of this subsection no later than January 1,
61 2010, and no later than January 1 each year thereafter. The
62 report shall summarize proposals received by the board during
63 the preceding fiscal year and actions taken by the board in
64 response to such proposals. In addition, the report shall
65 provide the following information for each university that has
66 been approved by the board to assess a tuition differential:
67 1. The amount of the tuition differential.
