1 A bill to be entitled
2 An act relating to comprehensive plan amendments;
3 establishing transmittal fees for proposed
4 comprehensive plan amendment packages sent to the
5 state land planning agency; requiring the state land
6 planning agency to deposit all fees collected into the
7 Operating Trust Fund within the Department of
8 Community Affairs; requiring the state land planning
9 agency to submit a report to the President of the
10 Senate and the Speaker of the House of Representatives
11 by a specified date; providing a declaration of
12 important state interest; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Paragraph (e) is added to subsection (3) of
17 section 163.3184, Florida Statutes, to read:
18 163.3184 Process for adoption of comprehensive plan or plan
19 amendment.—
20 (3) LOCAL GOVERNMENT TRANSMITTAL OF PROPOSED PLAN OR
21 AMENDMENT.—
22 (e) Every proposed comprehensive plan amendment package
23 transmitted to the state land planning agency pursuant to s.
24 163.3184(3) shall be accompanied by a $5,000 fee. Every proposed
25 comprehensive plan amendment package transmitted to the state
26 land planning agency pursuant to s. 163.32465(4) shall be
27 accompanied by a $6,500 fee. A proposed package containing one
28 or more amendments subject to review under s. 163.3184(3) and
29 one or more amendments subject to review under s. 163.32465(4)
30 shall be accompanied by a fee of $6,500. Every adopted
31 comprehensive plan amendment transmitted to the state land
32 planning agency pursuant to s. 163.3177(3(b)2. shall be
33 accompanied by a fee of $1,250. The state land planning agency
34 shall deposit all fees collected into the Operating Trust Fund
35 within the Department of Community Affairs. Not later than
36 October 1, 2010, the state land planning agency shall submit a
37 report to the President of the Senate and the Speaker of the
38 House of Representatives evaluating the fee collection.
39 Section 2. The Legislature finds and declares that this act
40 fulfills an important state interest.
41 Section 3. This act shall take effect July 1, 2009.
