       Senator Smith moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 526 and 527
    4  insert:
    5         Section 12. All funds collected from the cigarette and
    6  tobacco surcharge shall be deposited into the Health Care Trust
    7  Fund. If a majority of the voters of this state vote in favor of
    8  a referendum at the next general election approving the
    9  continuation of the cigarette and tobacco surcharge, the
   10  surcharge shall continue to be valid. If a majority of the
   11  voters of this state vote against the referendum approving the
   12  continuation of the cigarette and tobacco surcharge, the
   13  surcharge shall cease to be effective on the next business day
   14  following the day on which the results of the general election
   15  are certified.

   18         And the title is amended as follows:
   19         Delete line 70
   20  and insert:
   21  providing for the deposit of funds collected from the cigarette
   22  and tobacco surcharge into the Health Care Trust Fund; providing
   23  for the continuation of the cigarette and tobacco surcharge upon
   24  a favorable vote by the electors of this state on a referendum
   25  approving the continuation of the surcharge; providing that the
   26  surcharge shall cease to be effective on a specified date upon
   27  an unfavorable vote on such referendum; providing an effective
   28  date.
