    1                        A bill to be entitled                      
    2         An act relating to school districts; amending s.
    3         1001.42, F.S.; deleting provisions that require each
    4         district school board to reduce paperwork and data
    5         collection and report its findings and potential
    6         solutions on reducing burdens associated with such
    7         collection; amending s. 1008.31, F.S.; requiring that
    8         the Commissioner of Education monitor and review the
    9         collection of paperwork, data, and reports by school
   10         districts; requiring that the commissioner complete an
   11         annual review of such collection by a specified date
   12         each year; requiring that the commissioner prepare a
   13         report, by a specified date each year, assisting the
   14         school districts with eliminating or consolidating
   15         paperwork, data, and reports by providing suggestions,
   16         technical assistance, and guidance; providing an
   17         effective date.

   19  Be It Enacted by the Legislature of the State of Florida:
   20  
   21         Section 1. Subsections (24), (25), and (26) of section
   22  1001.42, Florida Statutes, as amended by section 2 of chapter
   23  2009-3, Laws of Florida, are amended to read:
   24         1001.42 Powers and duties of district school board.—The
   25  district school board, acting as a board, shall exercise all
   26  powers and perform all duties listed below:
   27         (24)REDUCE PAPERWORK AND DATA COLLECTION AND REPORTING
   28  REQUIREMENTS.—Beginning with the 2006-2007 school year:
   29         (a)Each district school board shall designate a classroom
   30  teacher to serve as the teacher representative to speak on
   31  behalf of the district’s teachers regarding paperwork and data
   32  collection reduction.
   33         (b)Each district school board must provide the school
   34  community with an efficient method for the school community to
   35  communicate with the classroom teacher designee regarding
   36  possible paperwork and data collection burdens and potential
   37  solutions.
   38         (c)The teacher designee shall annually report his or her
   39  findings and potential solutions to the school board.
   40         (d)Each district school board must submit its findings and
   41  potential solutions to the State Board of Education by September
   42  1 of each year.
   43         (e)The State Board of Education shall prepare a report of
   44  the statewide paperwork and data collection findings and
   45  potential solutions and submit the report to the Governor, the
   46  President of the Senate, and the Speaker of the House of
   47  Representatives by October 1 of each year.
   48         (24)(25) EMPLOYMENT CONTRACTS.—On or after February 1,
   49  2009, a district school board may not enter into an employment
   50  contract that is funded from state funds and that requires the
   51  district to pay an employee an amount in excess of 1 year of the
   52  employee’s annual salary for termination, buy-out, or any other
   53  type of contract settlement.
   54         (25)(26) ADOPT RULES.—Adopt rules pursuant to ss.
   55  120.536(1) and 120.54 to implement this section.
   56         Section 2. Present paragraph (c) of subsection (3) of
   57  section 1008.31, Florida Statutes, is redesignated as paragraph
   58  (e), and new paragraphs (c) and (d) are added to that
   59  subsection, to read:
   60         1008.31 Florida’s K-20 education performance accountability
   61  system; legislative intent; mission, goals, and systemwide
   62  measures; data quality improvements.—
   63         (3) K-20 EDUCATION DATA QUALITY IMPROVEMENTS.—To provide
   64  data required to implement education performance accountability
   65  measures in state and federal law, the Commissioner of Education
   66  shall initiate and maintain strategies to improve data quality
   67  and timeliness. All data collected from state universities
   68  shall, as determined by the commissioner, be integrated into the
   69  K-20 data warehouse. The commissioner shall have unlimited
   70  access to such data solely for the purposes of conducting
   71  studies, reporting annual and longitudinal student outcomes, and
   72  improving college readiness and articulation. All public
   73  educational institutions shall provide data to the K-20 data
   74  warehouse in a format specified by the commissioner.
   75         (c)The commissioner shall continuously monitor and review
   76  the collection of paperwork, data, and reports by school
   77  districts and complete an annual review of such collection no
   78  later than June 1 of each year. The annual review must include
   79  recommendations for consolidating paperwork, data, and reports,
   80  wherever feasible, in order to reduce the burdens on school
   81  districts.
   82         (d)By July 1 of each year, the commissioner shall prepare
   83  a report assisting the school districts in eliminating or
   84  consolidating paperwork, data, and reports by providing
   85  suggestions, technical assistance, and guidance.
   86         Section 3. This act shall take effect July 1, 2009.
