       The Committee on Criminal Justice (Dean) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 890 - 894
    4  and insert:
    5  subsection as the result of actions or inactions of the
    6  provider, or actions or inactions of any principal, officer,
    7  director, agent, managing employee, or affiliated person of the
    8  provider, or any partner or shareholder having an ownership
    9  interest in the provider equal to 5 percent or greater, in which
   10  the provider participated or acquiesced.
