    1                        A bill to be entitled                      
    2         An act relating to the Department of Transportation;
    3         amending s. 334.30, F.S.; prohibiting the department
    4         from entering into an agreement for the lease of an
    5         existing transportation facility to a corporation that
    6         obtains more than a specified percentage of its
    7         financing from extraterritorial corporations;
    8         providing an effective date.
    9         
   10  Be It Enacted by the Legislature of the State of Florida:
   11         
   12         Section 1. Subsection (14) is added to section 334.30,
   13  Florida Statutes, to read:
   14         334.30 Public-private transportation facilities.—The
   15  Legislature finds and declares that there is a public need for
   16  the rapid construction of safe and efficient transportation
   17  facilities for the purpose of traveling within the state, and
   18  that it is in the public's interest to provide for the
   19  construction of additional safe, convenient, and economical
   20  transportation facilities.
   21         (14) Notwithstanding any provision of law to the contrary,
   22  on or after July 1, 2009, the department may not enter into an
   23  agreement with a corporation as a concessionaire to lease the
   24  operation of an existing toll road if that corporation obtains
   25  more than 10 percent of its financing through one or more
   26  extraterritorial corporations.
   27         Section 2. This act shall take effect July 1, 2009.
