       The Committee on General Government Appropriations (Aronberg)
       recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 730 and 731
    4  insert:
    5         Section 10. Paragraph (c) of subsection (12) of section
    6  403.708, Florida Statutes, is amended to read:
    7         403.708 Prohibition; penalty.—
    8         (12) A person who knows or should know of the nature of the
    9  following types of solid waste may not dispose of such solid
   10  waste in landfills:
   11         (c) Yard trash in lined landfills classified by department
   12  rule as Class I landfills unless the landfill uses an active gas
   13  collection system to collect landfill gas generated at the
   14  disposal facility and provides or arranges for a beneficial
   15  reuse of the gas. Yard trash that is source separated from solid
   16  waste may be accepted at a solid waste disposal area where
   17  separate yard trash composting facilities are provided and
   18  maintained. The department recognizes that incidental amounts of
   19  yard trash may be disposed of in Class I landfills. In any
   20  enforcement action taken pursuant to this paragraph, the
   21  department shall consider the difficulty of removing incidental
   22  amounts of yard trash from a mixed solid waste stream.

   27  and insert:
   28         violators; amending s. 403.708, F.S.; authorizing the
   29         disposal of yard trash at a Class I landfill if the
   30         landfill has a system for collecting landfill gas and
   31         arranges for the reuse of the gas; amending ss. 712.03
   32         and 712.04, F.S.;
