    2         An act relating to the distribution of charter county
    3         transit system surtax proceeds; prohibiting certain
    4         counties from withholding surtax proceeds from certain
    5         municipalities; requiring certain counties to
    6         retroactively reimburse certain municipalities
    7         excluded from distributions of surtax proceeds for
    8         withheld surtax proceeds; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Notwithstanding the provisions of s.
   13  212.055(1)(d), Florida Statutes, a charter county with a
   14  population greater than 1.5 million according to the most recent
   15  decennial census may not withhold charter county transit system
   16  surtax proceeds from any municipality in the county incorporated
   17  after April 1, 2003. Any such charter county that entered into
   18  interlocal agreements with municipalities in the county after
   19  November 5, 2002, for distributions of charter county transit
   20  system surtax proceeds under s. 212.055, Florida Statutes, shall
   21  retroactively reimburse any municipality incorporated after
   22  April 1, 2003, which was excluded from distributions of surtax
   23  proceeds for any withheld surtax proceeds.
   24         Section 2. This act shall take effect July 1, 2009.
