| 15 | Florida Biodiversity Foundation license plate; providing |
| 16 | for the distribution of use fees received from the sale of |
| 17 | such plates; amending s. 320.02, F.S.; requiring the |
| 18 | application form for motor vehicle registration and |
| 19 | renewal of registration to include language permitting a |
| 20 | voluntary contribution to the Autism License Plate Fund |
| 21 | and Ronald McDonald Houses of Florida; providing for |
| 22 | distribution of such contributions; amending s. 320.0706, |
| 23 | F.S.; providing for the display of license plates on |
| 24 | wreckers; providing penalties; amending s. 322.08, F.S.; |
| 25 | requiring the application form for a driver's license or |
| 26 | duplicate thereof to include language permitting a |
| 27 | voluntary contribution to the Autism License Plate Fund; |
| 28 | providing an effective date. |
| 29 |

| 30 | Be It Enacted by the Legislature of the State of Florida: |
| 31 |
|
| 32 | Section 1. Paragraph (cc) of subsection (4) of section |
| 33 | 320.08056, Florida Statutes, is amended, paragraphs (qqq) |
| 34 | through (yyy) are added to that subsection, and subsections (13) |
| 35 | and (14) are added to that section, to read: |
| 36 | 320.08056 Specialty license plates.-- |
| 37 | (4) The following license plate annual use fees shall be |
| 38 | collected for the appropriate specialty license plates: |
| 39 | (cc) Choose Life license plate, $25 $20. |
| 40 | (qqq) Autism license plate, $25. |
| 41 | (rrr) Let's Go Surfing license plate, $25. |
| 42 | (sss) Florida Horse Park license plate, $25. |
| 43 | (ttt) St. Johns River license plate, $25. |
| 44 | (uuu) Endless Summer license plate, $25. |
| 45 | (vvv) Catch Me, Release Me license plate, $25. |
| 46 | (www) Fraternal Order of Police license plate, $25. |
| 47 | (xxx) Go Green Florida license plate, $25. |
| 48 | (yyy) Florida Biodiversity Foundation license plate, $25. |
| 49 | (13) Effective July 1, 2011, in addition to the |
| 50 | requirements of subsections (10) and (11) and notwithstanding |
| 51 | any specific authority provided in s. 320.08058, an organization |
| 52 | or entity receiving annual use fee revenue from the sale of a |
| 53 | specialty license plate may use no more than a total of 10 |
| 54 | percent of the revenues for administrative, marketing, and |
| 55 | promotion costs, including annual audit and compliance affidavit |
| 56 | costs. |
| 57 | (14) Notwithstanding any other provision of this chapter, |
| 58 | no annual use fee revenue derived from the sale of a specialty |
| 59 | license plate, or the interest thereon, shall be expended on |
| 60 | projects or programs outside this state. |
| 61 | Section 2. Subsection (29), paragraph (b) of subsection |
| 62 | (32), and subsection (35) of section 320.08058, Florida |
| 63 | Statutes, are amended, and subsections (69) through (77) are |
| 64 | added to that section, to read: |
| 65 | 320.08058 Specialty license plates.-- |
| 66 | (29) CHOOSE LIFE LICENSE PLATES.-- |
| 67 | (a) The department shall develop a Choose Life license |
| 68 | plate as provided in this section. The word "Florida" must |
| 69 | appear at the bottom of the plate, and the words "Choose Life" |
| 70 | must appear at the top of the plate. |
| 71 | (b) The annual use fees shall be distributed quarterly to |
| 72 | Choose Life, Inc., a s. 501(c)(3) nonprofit corporation, with a |
| 73 | list of annually to each county in the ratio that the annual use |
| 74 | fees collected by each county bears to the total fees collected |
| 75 | for the plates within the state. |
| 76 | (c) Up to 10 percent of the fees may be used for |
| 77 | administrative costs directly associated with the operations of |
| 78 | Choose Life, Inc., and activities by Choose Life, Inc., to |
| 79 | promote adoption and to market the license plate in this state. |
| 80 | Choose Life, Inc., shall administer distribution of the |
| 81 | remaining Each county shall distribute the funds to |
| 82 | nongovernmental, not-for-profit agencies within the county, |
| 83 | which agencies' services primarily consist of are limited to |
| 84 | counseling and meeting the physical needs of pregnant women who |
| 85 | are considering committed to placing their children for |
| 86 | adoption. |
| 87 | 1. Funds may not be distributed to any agency that is |
| 88 | involved or associated with abortion activities, including |
| 89 | counseling for or referrals to abortion clinics, providing |
| 90 | medical abortion-related procedures, or proabortion advertising, |
| 91 | and funds may not be distributed to any agency that charges |
| 92 | women for services received. |
| 93 | 2. Choose Life, Inc., may, from time to time, establish |
| 94 | criteria pertaining to appropriate percentages of expenditures |
| 95 | on items including, but not limited to, physical needs of women, |
| 96 | physical needs of infants awaiting adoption, counseling, |
| 97 | advertising, and training. |
| 98 | 3. Choose Life license plate funds generated in counties |
| 99 | that do not have a qualified service provider shall be |
| 100 | distributed by Choose Life, Inc., to qualified service providers |
| 101 | in other counties. |
| 102 | 4. Funds shall not be removed from a county with active |
| 103 | qualified service providers for distribution to service |
| 104 | providers in other counties unless year-end unused fund balances |
| 105 | exceed 20 percent of the county's annual Choose Life license |
| 106 | plate revenues for 3 consecutive years. If year-end fund |
| 107 | balances exceed 20 percent of a county's annual revenues for 3 |
| 108 | consecutive years, such balance may be distributed by Choose |
| 109 | Life, Inc., to qualified service providers in other counties. |
| 110 | 1. Agencies that receive the funds must use at least 70 |
| 111 | percent of the funds to provide for the material needs of |
| 112 | pregnant women who are committed to placing their children for |
| 113 | adoption, including clothing, housing, medical care, food, |
| 114 | utilities, and transportation. Such funds may also be expended |
| 115 | on infants awaiting placement with adoptive parents. |
| 116 | 2. The remaining funds may be used for adoption, |
| 117 | counseling, training, or advertising, but may not be used for |
| 118 | administrative expenses, legal expenses, or capital |
| 119 | expenditures. |
| 120 | 5.3. Each service provider agency that receives such funds |
| 121 | must submit an annual attestation to Choose Life, Inc., which |
| 122 | shall, upon request, make copies available to a state agency |
| 123 | charged with auditing the county. Any unused funds that exceed |
| 124 | 10 percent of the funds received by an agency during its fiscal |
| 125 | year must be returned to the county, which shall distribute them |
| 126 | to other qualified agencies. |
| 127 | 6. Choose Life license plate use fees generated in this |
| 128 | state may only be spent on activities within this state. |
| 129 | (d)1. Within 90 days after the effective date of this |
| 130 | paragraph, county commissions that have never distributed Choose |
| 131 | Life funds shall forward such funds to Choose Life, Inc., for |
| 132 | distribution. |
| 133 | 2. Within 180 days after the effective date of this |
| 134 | paragraph, county commissions that have been distributing Choose |
| 135 | Life funds shall forward fund balances to Choose Life, Inc., for |
| 136 | distribution. |
| 137 | (32) UNITED WE STAND LICENSE PLATES.-- |
| 138 | (b) The department shall retain all revenues from the sale |
| 139 | of such plates until all startup costs for developing and |
| 140 | issuing the plates have been recovered. Thereafter, |
| 141 | notwithstanding s. 332.14, 100 percent of the annual use fee |
| 142 | shall be distributed to the Department of Transportation SAFE |
| 143 | Council for the development and implementation of programs to |
| 144 | fund a grant program to enhance security at airports throughout |
| 145 | the state, pursuant to s. 332.14. Up to 10 percent of the annual |
| 146 | use fee revenue may be used for administration, promotion, and |
| 147 | marketing of the plate, including annual audit and compliance |
| 148 | affidavit costs. |
| 149 | (35) FLORIDA GOLF LICENSE PLATES.-- |
| 150 | (a) The Department of Highway Safety and Motor Vehicles |
| 151 | shall develop a Florida Golf license plate as provided in this |
| 152 | section. The word "Florida" must appear at the bottom of the |
| 153 | plate. The Dade Amateur Golf Association, following consultation |
| 154 | with the PGA TOUR, the Florida Sports Foundation, the LPGA, and |
| 155 | the PGA of America may submit a revised sample plate for |
| 156 | consideration by the department. |
| 157 | (b) The department shall distribute the Florida Golf |
| 158 | license plate annual use fee to the Dade Amateur Golf |
| 159 | Association, a s. 501(c)(3) organization Florida Sports |
| 160 | Foundation, a direct-support organization of the Office of |
| 161 | Tourism, Trade, and Economic Development. The license plate |
| 162 | annual use fees are to be annually allocated as follows: |
| 163 | 1. Up to 10 5 percent of the proceeds from the annual use |
| 164 | fees may be used by the Dade Amateur Golf Association Florida |
| 165 | Sports Foundation for the administration of the Florida Junior |
| 166 | Youth Golf Program. |
| 167 | 2. The Dade Amateur Golf Association shall receive the |
| 168 | first $80,000 in proceeds from the annual use fees for the |
| 169 | operation of youth golf programs in Miami-Dade County. |
| 170 | Thereafter, 15 percent of the proceeds from the annual use fees |
| 171 | shall be provided to the Dade Amateur Golf Association for the |
| 172 | operation of youth golf programs in Miami-Dade County. |
| 173 | 3. The remaining proceeds from the annual use fees shall |
| 174 | be available for grants to nonprofit organizations to operate |
| 175 | youth golf programs and for marketing the Florida Golf license |
| 176 | plates. All grant recipients, including the Dade Amateur Golf |
| 177 | Association, shall be required to provide to the Dade Amateur |
| 178 | Golf Association Florida Sports Foundation an annual program and |
| 179 | financial report regarding the use of grant funds. Such reports |
| 180 | shall be made available to the public. |
| 181 | (c) The Dade Amateur Golf Association shall Florida Sports |
| 182 | Foundation may establish a Florida Junior Golf Council Youth |
| 183 | Golf Program. The Florida Junior Golf Council Youth Golf Program |
| 184 | shall assist organizations for the benefit of youth, introduce |
| 185 | young people to golf, instruct young people in golf, teach the |
| 186 | values of golf, and stress life skills, fair play, courtesy, and |
| 187 | self-discipline. |
| 188 | (d) The Dade Amateur Golf Association Florida Sports |
| 189 | Foundation shall establish a seven-member Florida Junior Golf |
| 190 | Council committee to offer advice regarding the distribution of |
| 191 | the annual use fees for grants to nonprofit organizations. The |
| 192 | council advisory committee shall consist of one member from a |
| 193 | group serving youth, one member from a group serving disabled |
| 194 | youth, and five members at large. |
| 195 | (69) AUTISM LICENSE PLATES.-- |
| 196 | (a) The department shall develop an Autism license plate |
| 197 | as provided in this section. Autism license plates must bear the |
| 198 | colors and design approved by the department. The word "Florida" |
| 199 | must appear at the top of the plate, and the words "Support |
| 200 | Autism Programs" must appear at the bottom of the plate. |
| 201 | (b) The proceeds from the license plate annual use fee |
| 202 | shall be distributed to Achievement and Rehabilitation Centers, |
| 203 | Inc., to fund service programs for autism and related |
| 204 | disabilities throughout the state and to operate and establish |
| 205 | programs to support individuals with autism and related |
| 206 | disabilities through direct services, evaluation, training, and |
| 207 | awareness. Achievement and Rehabilitation Centers, Inc., shall |
| 208 | establish an Autism Services Grant Council that shall provide |
| 209 | grants from available Autism license plate proceeds to nonprofit |
| 210 | organizations for direct services and programs for individuals |
| 211 | with autism and related disabilities and their families. |
| 212 | Consideration for participation in such services and programs |
| 213 | shall be given to applicants who are children or adults with |
| 214 | autism and related disabilities and their families and shall |
| 215 | include those who are on the Agency for Persons with |
| 216 | Disabilities waiting lists for services. Achievement and |
| 217 | Rehabilitation Centers, Inc., shall also establish an Autism |
| 218 | License Plate Fund. Moneys in the fund shall be used by the |
| 219 | grant council as provided in this paragraph. All funds received |
| 220 | under this subsection must be used in this state. |
| 221 | (c) Achievement and Rehabilitation Centers, Inc., may |
| 222 | retain all proceeds from the annual use fee up to $85,000 until |
| 223 | all documented startup costs for developing and establishing the |
| 224 | plate have been recovered. Thereafter, the proceeds from the |
| 225 | annual use fee shall be used as follows: |
| 226 | 1. Up to 10 percent of the proceeds from the annual use |
| 227 | fee may be used for the administration of the Autism License |
| 228 | Plate Fund, the Autism Services Grant Council, and related |
| 229 | matters. |
| 230 | 2. Funds may be used as necessary for annual audit or |
| 231 | compliance affidavit costs. |
| 232 | 3. Thirty-five percent of the proceeds from the annual use |
| 233 | fee shall be used to establish and operate programs to support |
| 234 | individuals with autism and related disabilities and their |
| 235 | families through direct services, evaluation, training, and |
| 236 | awareness in the state. |
| 237 | 4. The Center for Autism and Related Disabilities at the |
| 238 | University of Miami shall receive 15 percent of the proceeds |
| 239 | from the annual use fee for distribution, as determined |
| 240 | appropriate by the director of that center, to the seven |
| 241 | regional autism centers created under s. 1004.55. The regional |
| 242 | centers shall use the proceeds to support the services they |
| 243 | provide. |
| 244 | 5. The remaining proceeds from the annual use fee shall be |
| 245 | available to the Autism Services Grant Council for grants to |
| 246 | nonprofit organizations to operate direct services programs for |
| 247 | individuals with autism and related disabilities and their |
| 248 | families and for marketing the Autism license plate. All grant |
| 249 | recipients, including Achievement and Rehabilitation Centers, |
| 250 | Inc., and the Center for Autism and Related Disabilities, shall |
| 251 | be required to provide to the Autism Services Grant Council an |
| 252 | annual program and financial report regarding the use of grant |
| 253 | funds. Such reports shall be made available to the public. |
| 254 | (d) Notwithstanding any provision of law to the contrary, |
| 255 | the first $10,000 in proceeds generated from voluntary |
| 256 | contributions to the Autism License Plate Fund authorized in ss. |
| 257 | 320.02 and 322.08 shall be retained by the department to offset |
| 258 | the department's implementation costs. |
| 259 | (70) LET'S GO SURFING LICENSE PLATES.-- |
| 260 | (a) The department shall develop a Let's Go Surfing |
| 261 | license plate as provided in this section. Let's Go Surfing |
| 262 | license plates must bear the colors and design approved by the |
| 263 | department. The word "Florida" must appear at the top of the |
| 264 | plate, and the words "Let's Go Surfing" must appear at the |
| 265 | bottom of the plate. |
| 266 | (b) The license plate annual use fees shall be distributed |
| 267 | to East Coast Surfing Hall of Fame and Museum, Inc., to fund |
| 268 | activities, programs, and projects to promote Florida's surfing- |
| 269 | related tourism, preserve Florida's surfing history and |
| 270 | heritage, preserve Florida's surf and shores, and honor |
| 271 | lifeguards who patrol Florida's surf and shores to protect |
| 272 | beachgoers, surfers, and others. East Coast Surfing Hall of Fame |
| 273 | and Museum, Inc., may retain all revenue from the annual use |
| 274 | fees until all startup costs for developing and establishing the |
| 275 | plate have been recovered. Thereafter, up to 10 percent of the |
| 276 | annual use fee revenue may be used for administration, |
| 277 | promotion, and marketing of the plate, including annual audit |
| 278 | and compliance affidavit costs. |
| 279 | (71) FLORIDA HORSE PARK LICENSE PLATES.-- |
| 280 | (a) The department shall develop a Florida Horse Park |
| 281 | license plate as provided in this section. Florida Horse Park |
| 282 | license plates must bear the colors and design approved by the |
| 283 | department. The word "Florida" must appear at the top of the |
| 284 | plate, and the words "Discover Florida's Horses" must appear at |
| 285 | the bottom of the plate. |
| 286 | (b) The annual use fees shall be distributed to the |
| 287 | Florida Agriculture Center and Horse Park Authority created by |
| 288 | s. 570.952, which shall retain all proceeds until all startup |
| 289 | costs for developing and establishing the plate have been |
| 290 | recovered. Thereafter, the proceeds shall be used as follows: |
| 291 | 1. A maximum of 10 percent of the proceeds from the annual |
| 292 | use fees may be used for the administration, promotion, and |
| 293 | marketing of the Florida Horse Park license plate. |
| 294 | 2. The remaining proceeds shall be used by the authority |
| 295 | to promote the Florida Agriculture Center and Horse Park located |
| 296 | in Marion County; to support continued development of the park, |
| 297 | including the construction of additional educational facilities, |
| 298 | barns, and other structures; to provide improvements to the |
| 299 | existing infrastructure at the park; and to provide for |
| 300 | operational expenses of the Florida Agriculture Center and Horse |
| 301 | Park. |
| 302 | (72) ST. JOHNS RIVER LICENSE PLATES.-- |
| 303 | (a) The department shall develop a St. Johns River license |
| 304 | plate as provided in this section. St. Johns River license |
| 305 | plates must bear the colors and design approved by the |
| 306 | department. The word "Florida" must appear at the top of the |
| 307 | plate, and the words "St. Johns River" must appear at the bottom |
| 308 | of the plate. |
| 309 | (b) The requirements of s. 320.08053 must be met prior to |
| 310 | the issuance of the plate. Thereafter, the license plate annual |
| 311 | use fees shall be distributed to the St. Johns River Alliance, |
| 312 | Inc., a s. 501(c)(3) nonprofit organization, which shall |
| 313 | administer the fees as follows: |
| 314 | 1. The St. Johns River Alliance, Inc., shall retain the |
| 315 | first $60,000 of the annual use fees as direct reimbursement for |
| 316 | administrative costs, startup costs, and costs incurred in the |
| 317 | development and approval process. Thereafter, up to 10 percent |
| 318 | of the annual use fee revenue may be used for administrative |
| 319 | costs directly associated with education programs, conservation, |
| 320 | research, and grant administration of the organization and for |
| 321 | promotion and marketing of the specialty license plate. |
| 322 | 2. At least 30 percent of the fees shall be available for |
| 323 | competitive grants for targeted community-based or county-based |
| 324 | research or projects for which state funding is limited or not |
| 325 | currently available. The remaining 50 percent shall be directed |
| 326 | toward community outreach and access programs. The competitive |
| 327 | grants shall be administered and approved by the board of |
| 328 | directors of the St. Johns River Alliance, Inc. A grant advisory |
| 329 | committee shall be composed of six members chosen by the St. |
| 330 | Johns River Alliance board members. |
| 331 | 3. Any remaining funds shall be distributed with the |
| 332 | approval of and accountability to the board of directors of the |
| 333 | St. Johns River Alliance, Inc., and shall be used to support |
| 334 | activities contributing to education, outreach, and springs |
| 335 | conservation. |
| 336 | (73) ENDLESS SUMMER LICENSE PLATES.-- |
| 337 | (a) The department shall develop an Endless Summer license |
| 338 | plate as provided in this section. Endless Summer license plates |
| 339 | must bear the colors and design approved by the department. The |
| 340 | word "Florida" must appear at the top of the plate, and the |
| 341 | words "Endless Summer" must appear at the bottom of the plate. |
| 342 | (b) The license plate annual use fees shall be distributed |
| 343 | to Surfing's Evolution & Preservation Corporation to fund its |
| 344 | activities, programs, and projects aimed at preserving the sport |
| 345 | of surfing. Surfing's Evolution & Preservation Corporation may |
| 346 | retain all revenue from the annual use fees until all startup |
| 347 | costs for developing and establishing the plate have been |
| 348 | recovered. Thereafter, up to 10 percent of the annual use fee |
| 349 | revenue may be used for promotion and marketing of the specialty |
| 350 | license plate and administrative costs directly associated with |
| 351 | the corporation's programs and the specialty license plate. |
| 352 | Surfing's Evolution & Preservation Corporation shall use the |
| 353 | remaining funds as follows: |
| 354 | 1. To fund the proposed Surfing's Evolution & Preservation |
| 355 | Experience project. |
| 356 | 2. To provide funds for the provision of lifeguards or the |
| 357 | building of artificial reefs. |
| 358 | 3. To provide funds to organizations that house the |
| 359 | history and artifacts of surfing or promote the sport through |
| 360 | exhibits, lectures, and events. |
| 361 | 4. To support programs and events of other organizations |
| 362 | that support beaches and oceans and promote education on beach |
| 363 | safety, coastal pollution, and beach ecology. |
| 364 | (74) CATCH ME, RELEASE ME LICENSE PLATES.-- |
| 365 | (a) The department shall develop a Catch Me, Release Me |
| 366 | license plate as provided in this section. Catch Me, Release Me |
| 367 | license plates must bear the colors and design approved by the |
| 368 | department. The word "Florida" must appear at the top of the |
| 369 | plate, and the words "Catch Me, Release Me" must appear at the |
| 370 | bottom of the plate. |
| 371 | (b) The license plate annual use fees shall be distributed |
| 372 | to the Guy Harvey Ocean Foundation, Inc., to fund marine-related |
| 373 | scientific research, including research of free-ranging pelagic |
| 374 | marine species that inhabit, use, or migrate through Florida |
| 375 | waters; conservation initiatives; and education and public |
| 376 | outreach programs targeting school-aged children in the state. |
| 377 | The Guy Harvey Ocean Foundation, Inc., may retain all revenue up |
| 378 | to $60,000 from the annual use fees until all startup costs for |
| 379 | developing and establishing the plate have been recovered. |
| 380 | Thereafter, up to 10 percent of the annual use fee revenue may |
| 381 | be used for administrative costs directly associated with the |
| 382 | operations of the Guy Harvey Ocean Foundation, Inc., and up to |
| 383 | 10 percent may be used for promotion and marketing of the |
| 384 | specialty license plate. |
| 385 | (75) FRATERNAL ORDER OF POLICE LICENSE PLATES.-- |
| 386 | (a) The department shall develop a Fraternal Order of |
| 387 | Police license plate as provided in this section. Fraternal |
| 388 | Order of Police license plates must bear the colors and design |
| 389 | approved by the department. The word "Florida" must appear at |
| 390 | the top of the plate, and the words "Fraternal Order of Police" |
| 391 | must appear at the bottom of the plate. |
| 392 | (b) In order to purchase the Fraternal Order of Police |
| 393 | license plate, a person must submit a certified letter from the |
| 394 | Florida State Lodge of the Fraternal Order of Police showing |
| 395 | that he or she qualifies for the use of the Fraternal Order of |
| 396 | Police law enforcement emblem by being a member in good |
| 397 | standing. |
| 398 | (c) The license plate annual use fees shall be distributed |
| 399 | to the Florida State Lodge Fraternal Order of Police Memorial |
| 400 | Foundation to fund its activities, programs, and projects aimed |
| 401 | at preserving, maintaining, and expanding the Florida Fraternal |
| 402 | Order of Police Law Enforcement Memorial. The Florida State |
| 403 | Lodge of the Fraternal Order of Police may retain all revenue |
| 404 | from the annual use fees until all startup costs for developing |
| 405 | and establishing the plate have been recovered. Thereafter, up |
| 406 | to 10 percent of the annual use fee revenue may be used for |
| 407 | promotion and marketing of the specialty license plate and |
| 408 | administrative costs directly associated with memorial programs |
| 409 | and the specialty license plate. The Florida State Lodge |
| 410 | Fraternal Order of Police Memorial Foundation shall use the |
| 411 | remaining funds as follows: |
| 412 | 1. To fund the Florida State Fraternal Order of Police Law |
| 413 | Enforcement Memorial projects. |
| 414 | 2. To provide funds for the expansion, maintenance, and |
| 415 | support of the Florida State Lodge Fraternal Order of Police |
| 416 | Memorial Foundation. |
| 417 | 3. To provide funds to organizations that help support the |
| 418 | families of law enforcement officers who have died in the line |
| 419 | of duty. |
| 420 | 4. To support programs and events that support the Florida |
| 421 | Fraternal Order of Police Law Enforcement Memorial. |
| 422 | (76) GO GREEN FLORIDA LICENSE PLATES.-- |
| 423 | (a) The department shall develop a Go Green Florida |
| 424 | license plate as provided in this section. Go Green Florida |
| 425 | license plates must bear the colors and design approved by the |
| 426 | department. The word "Florida" must appear at the top of the |
| 427 | plate, the words "Go Green" must appear on the bottom of the |
| 428 | plate, and the "Go Green Florida" emblem or logo must appear on |
| 429 | the plate. |
| 430 | (b) The requirements of s. 320.08053 must be met prior to |
| 431 | the issuance of the plate. The annual use fees shall be |
| 432 | distributed to the Coalition for Renewable Energy Solutions, |
| 433 | Inc. After reimbursement for documented costs expended to |
| 434 | establish the plate, the proceeds of the annual use fees shall |
| 435 | be used in the following manner: |
| 436 | 1. Up to 10 percent may be used by the Coalition for |
| 437 | Renewable Energy Solutions, Inc., for administrative, promotion, |
| 438 | and marketing costs. |
| 439 | 2. The remainder shall be used to fund the Renewable |
| 440 | Energy and Energy-Efficient Technologies Grants Program pursuant |
| 441 | to s. 377.804, the Solar Energy System Incentives Program |
| 442 | pursuant to s. 377.806, under the Florida Energy and Climate |
| 443 | Commission, or other educational programs dedicated to providing |
| 444 | effective alternative energy practices. |
| 445 | (c) The coalition shall comply with the financial audit |
| 446 | requirements of s. 320.08062. |
| 447 | (d) The "Go Green Florida" emblem or logo may be |
| 448 | authorized for use by the department in recognition of energy- |
| 449 | efficient vehicle usage and practices. The display of the decal |
| 450 | for energy-efficient practices may not be considered a |
| 451 | substitute for a legal license tag. |
| 452 | (77) FLORIDA BIODIVERSITY FOUNDATION LICENSE PLATES.-- |
| 453 | (a) The department shall develop a Florida Biodiversity |
| 454 | Foundation license plate as provided in this section. Florida |
| 455 | Biodiversity Foundation license plates must bear the colors and |
| 456 | design approved by the department. The word "Florida" must |
| 457 | appear at the top of the plate, and the words "Save Wild |
| 458 | Florida" must appear at the bottom of the plate. |
| 459 | (b) The annual use fees shall be distributed to the |
| 460 | Florida Biodiversity Foundation, Inc., which shall retain 50 |
| 461 | percent of the proceeds until the startup costs to develop and |
| 462 | establish the plates have been recovered. Thereafter, the |
| 463 | proceeds shall be used as follows: |
| 464 | 1. A maximum of 10 percent of the proceeds may be used to fund |
| 465 | fund the administrative, promotion, and marketing costs of the |
| 466 | license plate program and the foundation. |
| 467 | 2. The remaining fees shall be used by the foundation to fund |
| 468 | fund research, education, and scientific study of the diversity |
| 469 | of animals and plants and to aid in the preservation, study, |
| 470 | conservation, and recovery of imperiled organisms. |
| 471 | Section 3. Paragraphs (h) and (i) are added to subsection |
| 472 | (15) of section 320.02, Florida Statutes, to read: |
| 473 | 320.02 Registration required; application for |
| 474 | registration; forms.-- |

| 476 | (h) The application form for motor vehicle registration |
| 477 | and renewal of registration must include language permitting a |
| 478 | voluntary contribution of $5 to the Autism License Plate Fund |
| 479 | administered by Achievement and Rehabilitation Centers, Inc. |
| 480 | Except as provided in s. 320.08058(69)(d), such contributions |
| 481 | must be distributed by the department each month to the Autism |
| 482 | License Plate Fund administered by Achievement and |
| 483 | Rehabilitation Centers, Inc., to be used as provided in s. |
| 484 | 320.08058(69). |
| 485 | (i) The application form for motor vehicle registration |
| 486 | and renewal of registration must include language permitting a |
| 487 | voluntary contribution of $1 to Ronald McDonald Houses of |
| 488 | Florida. Such contributions must be distributed by the |
| 489 | department each month to Ronald McDonald House Charities Tampa |
| 490 | Bay, Inc., a not-for-profit organization. |
| 491 |

| 492 | For the purpose of applying the service charge provided in s. |
| 493 | 215.20, contributions received under this subsection are not |
| 494 | income of a revenue nature. |
| 495 | Section 4. Section 320.0706, Florida Statutes, is amended |
| 496 | to read: |
| 497 | 320.0706 Display of license plates on trucks.--The owner |
| 498 | of any commercial truck of gross vehicle weight of 26,001 pounds |
| 499 | or more shall display the registration license plate on both the |
| 500 | front and rear of the truck in conformance with all the |
| 501 | requirements of s. 316.605 that do not conflict with this |
| 502 | section. The owner of a dump truck may place the rear license |
| 503 | plate on the gate no higher than 60 inches to allow for better |
| 504 | visibility. However, the owner of a truck tractor shall be |
| 505 | required to display the registration license plate only on the |
| 506 | front of such vehicle. The owner of any wrecker issued a regular |
| 507 | wrecker license plate shall display the license plate only on |
| 508 | the front of the vehicle. The owner of any wrecker issued gross |
| 509 | vehicle weight wrecker license plates shall display the license |
| 510 | plates on both the front and rear of the vehicle in conformance |
| 511 | with the requirements of s. 316.605 that do not conflict with |
| 512 | this section. A violation of this section is a noncriminal |
| 513 | traffic infraction, punishable as a moving violation as provided |
| 514 | in chapter 318. |
| 515 | Section 5. Subsection (6) of section 322.08, Florida |
| 516 | Statutes, is amended to read: |
| 517 | 322.08 Application for license.-- |
| 518 | (6) The application form for a driver's license or |
| 519 | duplicate thereof shall include language permitting the |
| 520 | following: |
| 521 | (a) A voluntary contribution of $1 per applicant, which |
| 522 | contribution shall be deposited into the Health Care Trust Fund |
| 523 | for organ and tissue donor education and for maintaining the |
| 524 | organ and tissue donor registry. |
| 525 | (b) A voluntary contribution of $1 per applicant, which |
| 526 | contribution shall be distributed to the Florida Council of the |
| 527 | Blind. |
| 528 | (c) A voluntary contribution of $2 per applicant, which |
| 529 | shall be distributed to the Hearing Research Institute, |
| 530 | Incorporated. |
| 531 | (d) A voluntary contribution of $1 per applicant, which |
| 532 | shall be distributed to the Juvenile Diabetes Foundation |
| 533 | International. |
| 534 | (e) A voluntary contribution of $1 per applicant, which |
| 535 | shall be distributed to the Children's Hearing Help Fund. |
| 536 | (f) A voluntary contribution of $1 per applicant, which |
| 537 | shall be distributed to Family First, a nonprofit organization. |
| 538 | (g) A voluntary contribution of $5 per applicant, which, |
| 539 | except as provided in s. 320.08058(69)(d), shall be distributed |
| 540 | to the Autism License Plate Fund administered by Achievement and |
| 541 | Rehabilitation Centers, Inc., to be used as provided in s. |
| 542 | 320.08058(69). |

| 544 | A statement providing an explanation of the purpose of the trust |
| 545 | funds shall also be included. For the purpose of applying the |
| 546 | service charge provided in s. 215.20, contributions received |
| 547 | under paragraphs (b), (c), (d), (e), and (f), and (g) and under |
| 548 | s. 322.18(9)(a) are not income of a revenue nature. |
| 549 | Section 6. This act shall take effect September 1, 2009. |
