    1                        A bill to be entitled                      
    2         An act relating to local regulation of vessels;
    3         amending s. 327.60, F.S.; prohibiting certain
    4         ordinances or local laws relating to the operation and
    5         equipment of vessels from discriminating against
    6         airboats except by a unanimous rather than two-thirds
    7         vote of the governing body enacting such ordinance;
    8         providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (1) of section 327.60, Florida
   13  Statutes, is amended to read:
   14         327.60 Local regulations; limitations.—
   15         (1) The provisions of ss. 327.01, 327.02, 327.30-327.40,
   16  327.44-327.50, 327.54, 327.56, 327.65, 328.40-328.48, 328.52
   17  328.58, 328.62, and 328.64 shall govern the operation,
   18  equipment, and all other matters relating thereto whenever any
   19  vessel shall be operated upon the waterways or when any activity
   20  regulated hereby shall take place thereon. Nothing in these
   21  sections shall be construed to prevent the adoption of any
   22  ordinance or local law relating to operation and equipment of
   23  vessels, except that no such ordinance or local law may apply to
   24  the Florida Intracoastal Waterway and except that such
   25  ordinances or local laws shall be operative only when they are
   26  not in conflict with this chapter or any amendments thereto or
   27  regulations thereunder. Any ordinance or local law which has
   28  been adopted pursuant to this section or to any other state law
   29  may not discriminate against personal watercraft as defined in
   30  s. 327.02. Effective July 1, 2006, any ordinance or local law
   31  adopted pursuant to this section or any other state law may not
   32  discriminate against airboats except by a unanimous two-thirds
   33  vote of the governing body enacting such ordinance.
   34         Section 2. This act shall take effect July 1, 2009.
