The Policy and Steering Committee on Ways and Means (Alexander)
recommended the following:
1 Senate Amendment (with title amendment)

4 Delete lines 137 - 156
5 and insert:
6 (b) That requires the state to pay liquidated damages or
7 early termination fees for a breach or early termination of a
8 contract or agreement by such agency or branch due to an act of
9 the Legislature which provides less than full funding for the
10 contract during the fiscal year.
11 (c) That requires the state to pay interest, other than
12 interest paid pursuant to s. 215.422, to another party because
13 the agency or branch has insufficient budget authority to pay
14 the underlying obligation of the contract or agreement in the
15 current year.
16 (d) That binds the state to make future-year payments to
17 offset payments not made in a prior year due to insufficient
18 budget authority, unless the Legislature expressly authorizes
19 the agency or branch to enter into such contract or agreement.
20 (e) To grant to any party the right or privilege to collect
21 and retain fees or other revenues from persons who are not a
22 party to the contract which would otherwise be payable to the
23 state and deposited into the State Treasury, unless the
24 Legislature expressly authorizes the agency or branch to enter
25 into such contract or agreement.

28 And the title is amended as follows:

30 and insert:
31 legislative authority, liquidated damages or early

35 budget authority to pay an obligation in the current
36 year, from obligating the state to make future
37 payments to cover unpaid payments, or from granting to
38 a party the right to collect fees or
