Senator Garcia moved the following:
1 Senate Amendment to Amendment (927562) (with directory and
2 title amendments)

4 Between lines 1306 and 1307
5 insert:
6 (13) TRANSFER FEES.—No charge in excess of $100 may be made
7 by the association or anybody thereof in connection with the
8 sale, mortgage, lease, sublease, or other transfer of a parcel.
9 This subsection does not prohibit an association from requiring
10 as a condition to permitting the letting or renting of a parcel,
11 when the association has such authority in the documents, the
12 depositing into an escrow account maintained by the association
13 a security deposit in an amount not to exceed the equivalent of
14 1 month’s rent. The security deposit shall protect against
15 damages to the common areas or association property. Within 15
16 days after a tenant vacates the premises, the association shall
17 refund the full security deposit or give written notice to the
18 tenant of any claim made against the security. Disputes under
19 this subsection shall be handled in the same fashion as disputes
20 concerning security deposits under s. 83.49.
