       The Committee on Children, Families, and Elder Affairs (Justice)
       recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. The Secretary of Health Care Administration, the
    6  Secretary of Children and Family Services, the Executive
    7  Director of the Agency for Persons with Disabilities, and the
    8  Director of the Division of Vocational Rehabilitation shall
    9  jointly convene a work group to plan for a Medicaid Buy-in
   10  Program for Persons with Disabilities. The work group shall
   11  consist of staff from each agency with appropriate expertise in
   12  the needs of the disabled and the provision of services thereto.
   13  The work group will prepare a report to the Legislature which
   14  shall be due by December 1, 2009. The report will include an
   15  assessment of the feasibility of offering a Medicaid Buy-in
   16  Program for persons with disabilities and include at a minimum
   17  the following information:
   18         (a) Data on the number and characteristics of disabled
   19  persons to whom the Buy-in Program could be offered;
   20         (b) Description of the services to be offered under the
   21  Program;
   22         (c) Proposed premiums to be charged and the basis therefor;
   23         (d) Costs to the state Medicaid program of extending
   24  coverage through a Medicaid Buy-in Program, including costs of
   25  administration of the Buy-in Program;
   26         (e) A recommendation on how and by which entity the Buy-in
   27  Program should be administered;
   28         (f) Legislation for consideration during the 2010 Regular
   29  Session of the Legislature to implement the recommendations of
   30  the report.
   31         Section 2. This act shall take effect July 1, 2009.

   38         An act relating to the Medicaid Buy-in Program for
   39         Persons with Disabilities; requiring the Secretary of
   40         Health Care Administration, the Secretary of Children
   41         and Family Services, the Executive Director of the
   42         Agency for Persons with Disabilities, and the Director
   43         of the Division of Vocational Rehabilitation to
   44         convene a work group to examine the feasibility of
   45         offering a Medicaid Buy-in Program for persons with
   46         disabilities; requiring a report to the Legislature;
   47         providing an effective date.
