| 6 | (a) A future land use plan element designating proposed |
| 7 | future general distribution, location, and extent of the uses of |
| 8 | land for residential uses, commercial uses, industry, |
| 9 | agriculture, recreation, conservation, education, public |
| 10 | buildings and grounds, other public facilities, and other |
| 11 | categories of the public and private uses of land. Counties are |
| 12 | encouraged to designate rural land stewardship areas, pursuant |
| 13 | to the provisions of paragraph (11)(d), as overlays on the |
| 14 | future land use map. Each future land use category must be |
| 15 | defined in terms of uses included, and must include standards to |
| 16 | be followed in the control and distribution of population |
| 17 | densities and building and structure intensities. The proposed |
| 18 | distribution, location, and extent of the various categories of |
| 19 | land use shall be shown on a land use map or map series which |
| 20 | shall be supplemented by goals, policies, and measurable |
| 21 | objectives. The future land use plan shall be based upon |
| 22 | surveys, studies, and data regarding the area, including the |
| 23 | amount of land required to accommodate anticipated growth; the |
| 24 | projected population of the area; the character of undeveloped |
| 25 | land; the availability of water supplies, public facilities, and |
| 26 | services; the need for redevelopment, including the renewal of |
| 27 | blighted areas and the elimination of nonconforming uses which |
| 28 | are inconsistent with the character of the community; the |
| 29 | compatibility of uses on lands adjacent to or closely proximate |
| 30 | to military installations; the discouragement of urban sprawl; |
| 31 | energy-efficient land use patterns accounting for existing and |
| 32 | future electric power generation and transmission systems; |
| 33 | greenhouse gas reduction strategies; and, in rural communities, |
| 34 | the need for job creation, capital investment, and economic |
| 35 | development that will strengthen and diversify the community's |
| 36 | economy. The future land use plan may designate areas for future |
| 37 | planned development use involving combinations of types of uses |
| 38 | for which special regulations may be necessary to ensure |
| 39 | development in accord with the principles and standards of the |
| 40 | comprehensive plan and this act. The future land use plan |
| 41 | element shall include criteria to be used to achieve the |
| 42 | compatibility of adjacent or closely proximate lands with |
| 43 | military installations. In addition, for rural communities, the |
| 44 | amount of land designated for future planned industrial use |
| 45 | shall be based upon surveys and studies that reflect the need |
| 46 | for job creation, capital investment, and the necessity to |
| 47 | strengthen and diversify the local economies, and shall not be |
| 48 | limited |
| 49 | community. For communities designated as rural areas of |
| 50 | critical economic concern pursuant to s. 288.0656, the amount of |
| 51 | land designated for future planned industrial, residential, |
| 52 | commercial, or other land use shall be based upon surveys and |
| 53 | studies that reflect the need for job creation, capital |
| 54 | investment, and the necessity to strengthen and diversify the |
| 55 | local economies, and shall not be limited by the projected |
| 56 | population of the rural area of critical economic concern. The |
| 57 | future land use plan of a county may also designate areas for |
| 58 | possible future municipal incorporation. The land use maps or |
| 59 | map series shall generally identify and depict historic district |
| 60 | boundaries and shall designate historically significant |
| 61 | properties meriting protection. For coastal counties, the future |
| 62 | land use element must include, without limitation, regulatory |
| 63 | incentives and criteria that encourage the preservation of |
| 64 | recreational and commercial working waterfronts as defined in s. |
| 65 | 342.07. The future land use element must clearly identify the |
| 66 | land use categories in which public schools are an allowable |
| 67 | use. When delineating the land use categories in which public |
| 68 | schools are an allowable use, a local government shall include |
| 69 | in the categories sufficient land proximate to residential |
| 70 | development to meet the projected needs for schools in |
| 71 | coordination with public school boards and may establish |
| 72 | differing criteria for schools of different type or size. Each |
| 73 | local government shall include lands contiguous to existing |
| 74 | school sites, to the maximum extent possible, within the land |
| 75 | use categories in which public schools are an allowable use. The |
| 76 | failure by a local government to comply with these school siting |
| 77 | requirements will result in the prohibition of the local |
| 78 | government's ability to amend the local comprehensive plan, |
| 79 | except for plan amendments described in s. 163.3187(1)(b), until |
| 80 | the school siting requirements are met. Amendments proposed by a |
| 81 | local government for purposes of identifying the land use |
| 82 | categories in which public schools are an allowable use are |
| 83 | exempt from the limitation on the frequency of plan amendments |
| 84 | contained in s. 163.3187. The future land use element shall |
| 85 | include criteria that encourage the location of schools |
| 86 | proximate to urban residential areas to the extent possible and |
| 87 | shall require that the local government seek to collocate public |
| 88 | facilities, such as parks, libraries, and community centers, |
| 89 | with schools to the extent possible and to encourage the use of |
| 90 | elementary schools as focal points for neighborhoods. For |
| 91 | schools serving predominantly rural counties, defined as a |
| 92 | county with a population of 100,000 or fewer, an agricultural |
| 93 | land use category shall be eligible for the location of public |
| 94 | school facilities if the local comprehensive plan contains |
| 95 | school siting criteria and the location is consistent with such |
| 96 | criteria. Local governments required to update or amend their |
| 97 | comprehensive plan to include criteria and address compatibility |
| 98 | of adjacent or closely proximate lands with existing military |
| 99 | installations in their future land use plan element shall |
| 100 | transmit the update or amendment to the department by June 30, |
| 101 | 2006. |
