       Senator Baker moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 582 and 583
    4  insert:
    5         Section 7. Subsection (26) of section 334.044, Florida
    6  Statutes, is amended to read:
    7         334.044 Department; powers and duties.—The department shall
    8  have the following general powers and duties:
    9         (26) To provide for the enhancement of environmental
   10  benefits, including air and water quality, to prevent roadside
   11  erosion, to conserve the natural roadside growth and scenery,
   12  and for the implementation and maintenance of roadside
   13  conservation, enhancement, stabilization programs. of natural
   14  roadside growth and scenery and for the implementation and
   15  maintenance of roadside beautification programs, and No less
   16  than 1.5 percent of the amount contracted for construction
   17  projects shall be allocated by the department to the purchase of
   18  plant material and to the greatest beautification programs.
   19  Except where prohibited by federal law or federal regulation and
   20  to the extent practical, a minimum of 50 percent of these funds
   21  shall be used to purchase large plant materials with the
   22  remaining funds for other plant materials. All such plant
   23  materials shall be purchased from Florida commercial nursery
   24  Florida-based nurseryman stock on a uniform competitive bid
   25  basis. The department will develop grades and standards for
   26  landscaping materials purchased through this process. To
   27  accomplish these activities, the department may contract with
   28  nonprofit organizations having the primary purpose of developing
   29  youth employment opportunities.
